MI House Committee to Consider Breeder and Shelter Regulations Bill on June 3

The Michigan House Regulatory Reform Committee is discussing House Bill 5095 on Tuesday, June 3. This bill, among other provisions, will limit the number of dogs that can be kept on a single premises and define a “large scale commercial breeder kennel” based on how many intact female dogs someone owns, rather than actual sales.

Summary:

AKC’s concerns with House Bill 5095 include:

  • Problematic definition of “Large Scale Commercial Breeder Kennel” – This bill defines a commercial kennel as a kennel where more than 15 intact female dogs over 4 months of age are kept “for the purpose of breeding”. This vague definition has the effect of regulating people based on the property they own, rather than on actual breeding or commercial activity. As a result, many owners of multiple dogs who do not breed, or breed only an occasional litter would now find themselves improperly labeled as “commercial businesses” and in violation of their local zoning and HOA codes.
  • Arbitrary limit on dog ownership – The bill limits ownership to 50 intact females over 4 months of age. The AKC opposes arbitrary limits on ownership and believes that the focus should be on the health and welfare of the animals – regardless of how many are kept on a premises.
Other provisions of this measure include new regulations and reporting requirements for animal control and animal protection shelters and new regulations for those who meet the definition of “large scale commercial dog breeding kennel” who want to “import” a dog into the state.
