South Dakota Residents: Your Support Needed for Bill Prohibiting BSL to be Considered Tomorrow
AKC Government Relations has just learned that South Dakota Senate Bill 75, which seeks to prohibit local governments from enacting, maintaining, or enforcing regulations on certain dog breeds, will be considered by the South Dakota House Local Government Committee tomorrow, Thursday, February 27. It is imperative that all concerned South Dakota residents contact the committee members, listed below, and urge their support of this important, non-discriminatory legislation.
BILL SYNOPSIS: SB 75 prohibits local governments from enacting, maintaining, or enforcing regulations on certain dog breeds or perceived breeds of dogs. It originated in the Senate Local Government Committee, which passed it on January 31, 2014. The full Senate passed SB 75 on February 4. Reports suggest that the bill faces a much tougher challenge in the House because of opposition by local government stakeholders who wish to continue to be permitted to impose breed-specific restrictions in their municipalities. Such a challenge makes it imperative for concerned South Dakota residents to urge their legislators to support the bill.
AKC’S POSITION: The American Kennel Club strongly opposes any legislation that determines a dog to be “dangerous” based on specific breeds or phenotypic classes of dogs. We support laws that: establish a fair process by which specific dogs are identified as “dangerous” based on stated, measureable actions; impose appropriate penalties on irresponsible owners; and establish a well-defined method for dealing with dogs proven to be dangerous.
