The Board convened Monday, November 10, 2003 at 11:20 a.m. after the meetings of the various Board Committees. All Directors were present. The President, Chief Operating Officer and Executive Secretary were also present.
The Board reviewed the October 2003 minutes. Upon motion made by Dr. Davies and seconded by Ms. Scully, the minutes of the October 2003 meeting, copies of which were made available to all Directors, were adopted (unanimously).
The Chairman, Mr. Menaker, reported on the relief efforts in connection with the California wildfires.
Mr. Menaker reported that as a result of a suggestion Dr. Gerry Meisels submitted to him, the Executive Secretary has agreed to reformat the Board minutes, highlighting subjects to make them easier to find, thus improving communications with the Delegates.
The Chief Operating Officer, Mr. Sprung, reported on the Bank One credit card relationship and their advertising campaign in print and on television, which includes AKC's Affinity Card.
Mr. Menaker gave an update on the AKC/Eukanuba National Championship.
Conflict of Interest Committee
The Chairman reported the appointment of a committee to
evaluate all areas of possible conflict of interest situations within
AKC and the sport. It should detail the conflict provisions now
in place and make recommendations for possible modifications or further
provisions if required. Its goal is a wide-ranging and thorough study
of how, or if, conflict of interest situations warrant further regulation.
Consistency of policy in all areas is an important criteria

THE SCOPE
The committee will be charged with a thorough investigation of all possible conflict of interest situations, to include but not limited to the following:
- Delegate eligibility
- Judge eligibility
- AKC employees in the sport
- Judges, handlers, and exhibitors
- Breeder judges and exhibitors
- Commercial breeders and AKC
- Foreign judges judging in the USA
- Transfer of ownership between breeders, judges, exhibitors and handlers
- Loans, gifts, and business transactions between judges, handlers, and owners
- Judges and exhibitors serving on the same boards
THE PLAN
The committee will be instructed to draw up a plan and a timetable for its work. It will be required to make periodic reports to the Chairman on its progress. A final date for completion should be set.
Mr. Merriam chaired the meeting, while Mr. Menaker briefly recused himself. There was a motion by Dr. Mays, seconded by Mr. Goodman and it was VOTED (unanimously; abstaining, Mr. Menaker) to express the Board's full confidence in the conduct, integrity, and leadership of its Chairman.
The President , Mr. Cheauré, reported on registration trends. A presentation on this was given by AKC Internal Consultants Tom Sharp and Connie Pearcy via video conference.
Financial Report
Mr. Stevens, Chief Financial Officer, gave a financial update.
The month of October 2003 produced total revenues of $5.1 million compared to $4.9 million last year. The net surplus for the month was $691,000 compared to a net deficit of $387,000 during last October. Unrealized profits on investments were a significant component contributing towards the current month's results.
October's dog registrations were 75,884 vs. 77,749 last year, which was a decrease of 2.4%. Litter registrations of 35,055 were 2% lower in comparison to 35,753 last year.
There was a discussion on the 2004 Budget. Mr. Stevens was present for this discussion.

were present. The President, Chief Operating Officer and Executive Secretary

The Board went into Executive Session.
Appointment of Acting President/CEO 1/1/04
When the Board returned to regular session, it was reported that Dennis
Sprung was appointed Acting President/CEO, effective January 1,
2004. It was also reported that the January 2004 Board meeting will be
in Raleigh, NC.
Bylaw Amendment
The Board considered a proposed amendment to ARTICLE XV, SECTION 4 of
the AKC Bylaws, which would enable an AKC club to hold non-AKC events
if AKC gives its permission. Following a motion by Mr. Merriam, seconded
by Mr. Marden, it was VOTED (affirmative, Mr. Merriam, Mr. Marden, Mr.
Goodman, Mr. Gladstone, Ms. Scully, Mrs. Strand, Dr. Battaglia, Dr. Garvin,
Mr. Menaker, Dr. Haines, Mrs. Schaefer, Dr. Davies; opposed, Dr. Mays)
to approve an amendment to ARTICLE XV, SECTION 4 to be read at the December
2003 Delegates meeting for a VOTE in March 2004 as follows: (addition
underlined)
"Any AKC club, association or organization which shall hold a purebred dog event or dog exhibition of any kind not in accordance with the rules of the AKC which apply to such purebred dog event or exhibition without the express permission of the AKC may be disciplined even to the extent of being deprived of all privileges of the AKC for a stated period of time or indefinitely, and if such club, association or organization shall be a member of the AKC, it may be expelled from membership therein."
Mr. Merriam, Mr. Marden, and Dr. Haines, members of the Appeals Committee, left the meeting prior to the report on Judges Applications.

Following completion of the report on Judges Applications, Mr. Merriam, Mr. Marden and Dr. Haines returned to the meeting.
There was a motion by Mr. Gladstone, seconded by Dr. Davies, to publish the vote on judges' applications. Mr. Merriam proposed and Mr. Gladstone accepted as an amendment to his motion that the minutes include the breeds applied for, the staff recommendations and vote, the breeds denied, and the Board VOTE. The amended motion was defeated, with the VOTE (affirmative, Mr. Gladstone, Mr. Merriam; opposed, Mr. Menaker, Ms. Scully, Dr. Garvin, Dr. Haines, Mrs. Schaefer, Mrs. Strand, Dr. Battaglia, Mr. Marden, Mr. Goodman, Dr. Mays; abstaining, Dr. Davies).
Compliance
There was a report on the actions taken by the AKC staff during the month
of October 2003 on the cancellation of litters and individual registrations.
During the month of October, the registrations of 104 litters were cancelled: 2 at the request of the litter owner(s) and 102 as a result of DNA Parentage Evaluation.
The cancellation of the 104 litters resulted in the cancellation of 128 registered dogs and rendered 339 dogs, members of these litters, ineligible for registration.
The following actions taken by the AKC Management Disciplinary Committee were reported:
Theresa Whitney (Yucca Valley, CA) was suspended by the Kennel Club of Riverside for conduct at its September 27, 2003 event. Specifically, Ms. Whitney was charged with inappropriate treatment of an animal, abusive or foul language/verbal altercation and physical abuse. Ms. Whitney attempted to take possession of a dog she co-owned during the event. The AKC Management Disciplinary Committee acted to suspend Ms. Whitney for inappropriate treatment of an animal and abusive or foul language/verbal altercation. The committee did not find sufficient evidence to support the charge of physical abuse. Therefore, Ms. Whitney's event privileges were suspended for a period of 6 months and a $1000 fine was imposed, effective September 27, 2003.
Shelle Enright (Yucca Valley, CA) was suspended by the Kennel Club of Riverside for conduct at its September 27, 2003 event. Specifically, Ms. Enright was charged with inappropriate treatment of an animal, abusive or foul language/verbal altercation and physical abuse. Ms. Enright assisted a co-owner of a dog who was attempting to take possession of the dog during the event. The AKC Management Disciplinary Committee acted to suspend Ms. Enright's event privileges for inappropriate treatment of an animal and abusive and foul language/verbal altercation. The committee did not find sufficient evidence to support the charge of physical abuse. Therefore, Ms. Enright was suspended for a period of 6 months and a $1000 fine was imposed, effective September 27, 2003.
Jeff Ryman (Snohomish, WA) was suspended by the Richland Kennel Club for conduct at its September 28, 2003 event. Specifically, Mr. Ryman was charged with physical abuse at an event. An individual took offense of Mr. Ryman's actions when he was talking loudly during the Pledge of Allegiance. This resulted in an altercation in which Mr. Ryman placed his hand on an individual's shoulder. The AKC Management Disciplinary Committee reviewed the club's report and found it to be in order. However, they did not feel that Mr. Ryman's actions supported the charge of physical abuse. The committee did feel that Mr. Ryman's conduct did warrant some type of reprimand but not a suspension. As a result, the suspension was nullified.
The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective November 10, 2003, and imposed fines of $2000 each for failure to comply with the recordkeeping and identification requirements of Chapter 4 of the Rules Applying to Registration and Discipline. Further, reinstatement will be contingent upon their beginning with a new colony:

The AKC's Management Disciplinary Committee has suspended Larry Beegle (New Paris, PA) from all AKC privileges for a period of ten (10) years, effective November 10, 2003, and imposed a $2000 fine for failure to comply with the rules and regulations for record keeping and identification and failure to maintain his dogs and facilities in a manner acceptable to The American Kennel Club. (Multiple Breeds)
The AKC's Management Disciplinary Committee has suspended Angela Holloway (New Paris, PA) from all AKC privileges for a period of ten (10) years, effective November 10, 2003, and imposed a $2000 fine for failure to comply with the rules and regulations for record keeping and identification and failure to maintain her dogs and facilities in a manner acceptable to The American Kennel Club. (Multiple Breeds)
Appeals Committee Report
Mr. Merriam gave the report of the Appeals Committee. Two
appeals were heard by Mr. Merriam and Dr. Haines, with Mr. Marden recusing
himself because of prior knowledge of the cases. The first appeal was
from Bob Erbe. The Board suspended Mr. Erbe's judging privileges for three
years, effective July 7, 2003, for conduct unbecoming a judge. While handling
a dog in a stake at the Ozark German Shorthaired Pointer Club's March
14, 2003 trial, he used a tracking device to scout a dog in contention.
The second appeal was from Charles Carr, whose judging privileges were
suspended, effective July 7, 2003, as a result of his refusing to sign
the judges book when the judges could not agree on placements in a stake
at the Gordon Setter Club of America's April 27, 2003 trial. The committee
recommended that both appeals be denied, with the original date of suspension
applying. The Board voted to adopt this recommendation.
Breeders Committee
Mr. Goodman gave the Breeders Committee report. He indicated that the
committee will be meeting with the 2003 Breeders of the Year in order
to obtain their input on how AKC could best serve new and experienced
breeders.
Events and Clubs Committee
Dr. Davies gave the Events and Clubs Committee Report on fines assessed
clubs for late submission of date applications and judges panels.

The Board considered an appeal from the Greater Chicago Papillon
Club for an exception of the Board policy limiting the distance
from its area a club may go to cluster with a National Specialty. Following
a motion by Dr. Davies, seconded by Mrs. Strand, it was VOTED (affirmative,
Dr. Davies, Mrs. Strand, Mr. Menaker, Ms. Scully, Mr. Goodman, Mr. Marden,
Dr. Battaglia, Dr. Haines, Dr. Garvin, Mr. Gladstone, Dr. Mays; opposed,
Mr. Merriam, Mrs. Schaefer) to deny the appeal.
The Board considered a proposed amendment submitted by the Delegate Parent Clubs Committee, which would, under certain circumstances, provide points for Reserve. The exact proposal would amend Chapter 16, Section 1 of the Rules Applying to Dog Shows to read as follows: (The additions are underlined.)
"Championship points will be recorded for Winners Dog and Winners Bitch, and in certain cases explained below, for Reserve Winners Dog and Reserve Winners Bitch for each breed or variety listed in Chapter 3, Section 1, at licensed or member dog shows approved by The American Kennel Club, provided the certification of the Secretary as described in Chapter 6, Section 1, has been printed in the premium list for the show.
Championship points will be recorded according to the number of eligible dogs competing in the regular classes of each sex in each breed or variety, and according to the Schedule of Points established by the Board of Directors.
If the dog designated Winners Dog or Winners Bitch is also awarded Best of Breed or Variety, the dogs of both sexes that have been entered for Best of Breed or Variety competition and that have been defeated in such competition, shall be counted in addition to the dogs that competed in the regular classes for its sex in calculating championship points.
If the dog designated Winners Dog or Winners Bitch is also awarded Best of Opposite Sex to Best of Breed or Variety, the dogs of its own sex that have been entered for Best of Breed or Variety competition and that have been defeated in competition for Best of Opposite Sex shall be counted in addition to the dogs that competed in the regular classes for its sex in calculating championship points.
The dog awarded the Best of Winners shall be credited with the number of points calculated for Winners Dog or Winners Bitch, whichever is greater.
At one National Specialty each year, specified by the AKC Breed Parent Specialty Club at the time the event application is submitted to AKC, the dog designated Reserve Winners Dog and/or Reserve Winners Bitch will be awarded a three-point major, provided the number of dogs competing in the regular classes of that Reserve Winner's sex totals at least twice the number required for a 5 point major.
In counting the number of eligible dogs in competition, a dog that is disqualified, or that is dismissed, excused or ordered from the ring by the judge, or from which all awards are withheld, shall not be included."
Following a motion by Dr. Davies, seconded by Ms. Scully, it was VOTED (affirmative, Dr. Davies, Ms. Scully, Mr. Merriam, Mr. Goodman, Mrs. Strand, Mrs. Schaefer, Dr. Battaglia, Dr. Garvin, Dr. Haines, Mr. Menaker, Dr. Mays, Mr. Gladstone, opposed; Mr. Marden) to disapprove the proposed amendment.
The Board reviewed the Event Committee's handling of an incident that occurred at the German Shepherd Dog Club of America's October 9, 2003 specialty show, involving an alleged physical altercation. Dr. Battaglia recused himself from the discussion as the club's Delegate. The club received a complaint and held a preliminary investigation, concluding that the incident, if proven, would constitute prejudicial conduct. However, when the complaint was later withdrawn, the committee believed it could not go forward and took no further action. Following a motion by Dr. Davies, seconded by Dr. Garvin, it was VOTED (unanimously; Dr. Battaglia not participating in the vote) to officially reprimand the German Shepherd Dog Club of America and to impose a $2,500 fine for its failure to properly handle an alleged act of misconduct at its show.
Mr. Cheauré reported that, in accordance with ARTICLE XII, SECTION 3 of the AKC Bylaws, the incident at the German Shepherd Dog Club of America's October 2003 show will be investigated and that, if warranted, charges will be filed and the Board notified accordingly.
The Board considered a request from the American Cesky Terrier Club, endorsed by the Delegate Herding, Earthdog and Coursing Committee, to permit the breed to compete in AKC Earthdog events. Following a motion by Ms. Scully, seconded by Mr. Marden, it was VOTED (unanimously) to amend Chapter 1, Section 6 of the Regulations for Earthdog Tests to include Cesky Terriers, effective January 1, 2004.
The Board considered a request from the German Shorthaired Pointer Club of America to establish a National Open Gun Dog Walking Championship, which would be in addition to its National Open Gun Dog Championship. Following a motion by Ms. Scully, seconded by Dr. Davies, it was VOTED (affirmative, Ms. Scully, Dr. Davies, Mr. Merriam, Mr. Goodman, Mrs. Strand, Mrs. Schaefer, Dr. Battaglia, Dr. Garvin, Dr. Haines, Mr. Menaker, Dr. Mays, Mr. Gladstone; Mr. Marden abstaining) to deny the request.
Following a motion by Mr. Marden, seconded by Ms. Scully, it was VOTED (unanimously) to approve the qualifications for the English Setter Association of America's 2004 National Championship Field Trial as follows:
- In order for a dog to be eligible to enter the English Setter National
Championship, it must have placed first, second, third or fourth in
All-Age Stakes (Open or Amateur), Limited All-Age Stakes (Open or Amateur),
Open Gun Dog, Open Limited Gun Dog, Amateur Gun Dog or Amateur Limited
Gun Dog at an American Kennel Club field trial.
- Further, to be eligible to enter the English Setter National Championship, a dog must have a DNA profile on file with the AKC and have permanent identification in the form of a microchip. Proof of the above must be provided to the Field Trial Secretary with the entry. Dogs will be checked on the field trial grounds prior to running.
Business Committee
Mr. Merriam gave the report from the Business Committee. The committee
discussed television rights for AKC events and long-term strategic planning.
Operations and Planning Committee
Dr. Battaglia gave a report from the Operations and Planning Committee.
Following a motion by Dr. Battaglia, seconded by Mr. Merriam, it was VOTED (unanimously) to add the Union Cynologique Saint Hubert du Grand Duché de Luxembourg to the list of registries with pedigrees acceptable for AKC registration.
Following a motion by Ms. Scully, seconded by Mr. Marden, it was VOTED (unanimously) to approve a request from the Canadian Kennel Club that AKC accept pedigrees from the Canadian Livestock Records Corporation for Canadian-bred American Eskimo Dogs until the breed becomes registrable with the Canadian Kennel Club.
Public Relations and Public Affairs Committee
Mrs. Strand gave a report from the Public Relations and Public Affairs
Committee. The committee discussed AKC's legislative initiative to amend
the Animal Welfare Act, the AKC web site, publications and print ads for
AKC. Mrs. Strand reported that the 2004 Breeder of the Year
award winners are:

2004 Budget
There was further discussion on the 2004 Budget. There was a motion by
Mr. Gladstone, seconded by Mr. Merriam, to reduce the expenses in the
Judging Operations Department by 50%. The motion was defeated, with the
VOTE (affirmative, Mr. Gladstone, Mr. Merriam; opposed, Mr. Menaker, Dr.
Mays, Dr. Battaglia, Ms. Scully, Dr. Haines, Dr. Davies, Mr. Goodman,
Dr. Garvin, Mr. Marden, Mrs. Strand, Mrs. Schaefer).
There was a motion by Dr. Battaglia, seconded by Mrs. Schaefer, to hold 2004 travel expenses to the 2003 level. The motion was defeated, with the VOTE (affirmative, Dr. Battaglia, Mrs. Schaefer, Mr. Merriam, Mr. Gladstone; opposed, Mr. Menaker, Dr. Mays, Dr. Haines, Mr. Marden, Mr. Goodman, Ms. Scully, Mrs. Strand, Dr. Garvin, Dr. Davies).
There was a motion by Mrs. Strand, seconded by Mr. Goodman, and it was VOTED (affirmative, Mrs. Strand, Mr. Goodman, Mr. Merriam, Mr. Menaker, Mr. Marden, Dr. Davies, Dr. Garvin, Dr. Battaglia, Dr. Haines, Dr. Mays, Ms. Scully, Mrs. Schaefer; opposed, Mr. Gladstone) to approve the 2004 Budget.
The Board recessed and went into Workshop Sessions on AKC event television rights, the criteria for Registered Kennel Names, a Publications review, judging approvals, and AKC interaction with High Volume Breeders.
