AKC Board Minutes
May 2003

The Board convened Monday, May 12, 2003 at 11:05 a.m. after the meetings of the various Board Committees. All Directors were present except Mrs. Strand. The Chief Operating Officer and Executive Secretary were also present.

The Board reviewed the April 2003 minutes. Upon motion made by Dr. Davies and seconded by Ms. Scully, the minutes of the April 2003 meeting, copies of which were made available to all Directors, were adopted (unanimously; absent, Mrs. Strand).

The Chairman, Mr. Menaker extensively reported on the status of the registration system. Through a number of measures taken in the last three weeks including extensive overtime, temporary help, and outside computer consultants, the large backlog in registration applications has been substantially eliminated. However, Mr. Menaker cautioned that until flaws in the current computer system are corrected, there will have to be continued overtime and temporary workers or the backlog will quickly build again.

Mr. Menaker reported that the cost to stabilize the current registration system since the new system went live was $628,000. In addition, the estimated additional cost to continue operating the registration system for the remainder of 2003 is $1,353,000. The cost estimate to redesign and implement the needed system modifications and the on-line registration process is estimated to be $500,000. Following a motion by Mr. Merriam, seconded by Dr. Davies, it was VOTED (unanimously; absent, Mrs. Strand) to move $2,500,000 from the Operating Reserves to a new Special Reserve for Systems Redesign and to approve the above expenditure.

The President, Mr. Cheauré, reported further on the status of the registration reengineering and on pet insurance.

Mr. Stevens gave a financial update. The Financial Report for the month of April 2003 showed total revenue of $5.4 million and a net surplus of $555,000 after all expenses.

The individual registration figures for April 2003 are 83,044, versus 93,159 for April 2002.

The litter registration figures for April 2003 are 34,138, versus 37,079 for April 2002.

The Executive Secretary, Mr. Crowley, reported on a request from the AKC Canine Health Foundation for AKC sponsorship of a September 19-21, 2003 Parent Clubs Health Conference in St. Louis, MO. The request was for a $50,000 grant. In return, AKC would be featured in all pre- and post-event publicity, have a banner at the event as well as a booth, and provide guest speakers. Following a motion by Mrs. Schaefer, seconded by Dr. Davies, it was VOTED (unanimously; absent, Mrs. Strand) to approve the request.

The Board considered a request from the Cudahy Kennel Club for financial assistance to help cover losses resulting from a lawsuit. An exhibitor died at the club's August 1997 show and the club was sued for not having an Advanced Life Support Ambulance on the grounds per the AKC policy that was to take effect in January 1997, but which was suspended for reconsideration in September 1997. While the club won the suit, it had expended several thousand dollars. Following a motion by Ms. Scully, seconded by Mrs. Schaefer, it was VOTED (unanimously; absent, Mrs. Strand) to deny the request.

Mr. Merriam, Mr. Marden, and Dr. Haines, members of the Appeals Committee, left the meeting prior to the report on Judges Applications.

Mr. Hayes and Ms. Ford, staff, participated in the discussion on Judges Applications by video conference. Upon motion made and seconded, it was VOTED:

Following completion of the report on Judges Applications, Mr. Merriam, Mr. Marden and Dr. Haines returned to the meeting.

There was a report on the actions taken by the AKC staff during the month of April 2003 on the cancellation of litters and individual registrations.

During the month of April, the registrations of 13 litters were cancelled: 6 because of impure breeding, 1 at the request of the litter owner(s) and 6 as a result of DNA Parentage Evaluation.
The cancellation of the 13 litters resulted in the cancellation of 12 registered dogs and rendered 39 dogs, members of these litters, ineligible for registration.

The following actions taken by the AKC Management Disciplinary Committee were reported:

Frank Tingley II (Winston-Salem, NC) was suspended by the Piedmont Kennel Club for conduct at their event on April 5, 2003. Specifically, Mr. Tingley was charged with using foul and abusive language towards another exhibitor at an event. Mr. Tingley both admitted and apologized for his actions. The AKC Management Disciplinary Committee acted to issue a letter of reprimand and impose a $100 fine.

The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective May 12, 2003, and imposed a $2000 fine each for having refused to permit an inspection of records and practices, as provided by Chapter 4, Section 7 of the Rules Applying to Registration and Discipline:

The AKC's Management Disciplinary Committee has suspended the following individual from all AKC privileges for a period of ten years, effective May 12, 2003, and imposed a $2000 fine for conduct considered prejudicial to the best interests of purebred dogs in connection with the conviction as indicated:

The AKC's Management Disciplinary Committee has suspended Amber Harrison (Wichita, KS) from all AKC privileges for a period of one year, effective May 12, 2003, and imposed a $1000 fine for having entered, or caused to be entered, a female Chow Chow who had been altered by artificial means. The AKC's Management Disciplinary Committee has suspended Doris Harrison (Wichita, KS) from all AKC privileges for a period of one year, effective May 12, 2003, and imposed a $1000 fine for having entered, or caused to be entered, a female Chow Chow who had been altered by artificial means. The AKC's Management Disciplinary Committee has suspended Sally Shephard (Sedalia, MO) from all AKC privileges for a period of six months, effective May 12, 2003, and imposed a $500 fine for having submitted, or caused to be submitted, two litter applications, which she knew, or should have known, contained false certifications. (Rottweiler)

The Board considered a request from the Shetland Sheepdog Club of Northern Alabama and the Birmingham Shetland Sheepdog Club for permission to both hold a show on November 15, with one in the morning and one in the afternoon. Following a motion by Ms. Scully, seconded by Dr. Garvin, it was VOTED (affirmative, Ms. Scully, Dr. Garvin, Mr. Merriam, Mr. Goodman, Dr. Davies, Dr. Battaglia, Mr. Gladstone, Mr. Marden, Mr. Menaker, Dr. Haines; opposed, Dr. Mays, Mrs. Schaefer; absent, Mrs. Strand) to deny the request.

The Board reviewed the current Point Schedule. The Events and Clubs Committee had considered counting shows with no dogs competing in a breed in the calculations. However, evaluating the impact, it was determined that there would be a drastic increase in the number of points awarded, no change was recommended. Following a motion by Mr. Marden, seconded by Dr. Davies, it was VOTED (unanimously; absent Mrs. Strand) to maintain the present system.

The Events and Clubs Committee did recommend that one change be made in the Division realignment, with Divisions 4 and 14 (Florida) being combined. This change would be effective for shows held on and after July 1, 2003. There was a motion by Mr. Goodman, seconded by Dr. Davies, to approve the change, which was defeated with the VOTE (affirmative, Dr. Davies, Ms. Scully, Mr. Menaker, Mrs. Schaefer, Mr. Goodman; opposed, Mr. Merriam, Dr. Garvin, Mr. Gladstone, Dr. Battaglia, Dr. Haines, Dr. Mays, Mr. Marden; absent, Mrs. Strand).

The Board reviewed the procedures for the water test for Cocker and English Cocker Spaniel Field Trials. Following a motion by Mr. Marden, seconded by Mr. Gladstone, it was VOTED (unanimously; absent, Mrs. Strand) to insert the following after the words at the end of the third sentence .... for its entry in Procedure 13 of the Field Trial Rules and Standard Procedure for Spaniels:

"Before an American Cocker or an English Cocker Spaniel shall receive its Field or Amateur Field Championship, it must have shown its willingness and ability to retrieve game from or across water, after a swim. The water test shall consist of a one or two bird retrieve which shall be at the option of the Field Trial Committee. The birds used shall be available dead game birds such as pheasants, ducks or various partridges. The dog and handler are to be backed up 5 to 10 yards from the water entry. The dog shall retriever a dead game bird, thrown with gunshot, after a 20-30 yard swim." ...A water test...

The above is effective September 1, 2003.

The Board considered a proposal from the Retriever Advisory Committee concerning the handling of marks in a Derby Stake. The intent of the proposal is to make it clear that a handle on a mark in a Derby Stake requires elimination of the dog from the stake. Following a motion by Dr. Davies, seconded by Ms. Scully, it was VOTED (unanimously; absent, Mrs. Strand) to add a new number 17 to the listing of serious faults, as follows:

17. Handling on a mark in a Derby Stake.

and to amend paragraph 1, and part II, Evaluation of Dog Work, Natural Abilities, in the Supplement to the Standard Procedure as follows:

Add immediately after the word "all-important" the following words: "... and dogs that are handled on a mark in a Derby Stake shall be eliminated."

This change will be effective January 1, 2004.

Following a motion by Dr. Davies, seconded by Mr. Goodman, it was VOTED (unanimously; absent, Mrs. Strand) to amend Chapter 14, Section 10 of the Field Trial Rules and Standard Procedure for Retrievers by adding the following language at the end of the first paragraph:

"Derby Stake tests are limited to marked retrieves and dogs which are handled on such retrieves shall be eliminated from competition."

This amendment will be read at the June 2003 Delegates meeting, with a VOTE in September and a January 1, 2004 effective date.

Following a motion by Dr. Davies, seconded by Mr. Goodman, it was VOTED (unanimously; absent, Mrs. Strand) to amend Chapter 14, Section 10 of the Field Trial Rules and Standard Procedure for Retrievers by inserting a new third paragraph to read as follows:

"An Owner-Handler Qualifying Stake may be run in place of a Qualifying Stake at the election of the trial giving club and shall be open to all dogs eligible to run a Qualifying Stake provided that each entered dog is handled by the registered owner or co-owner of such dog or a member of said owner or co-owner's family as defined in Section 2 of this chapter."

This amendment will be read at the June 2003 Delegates meeting, with a VOTE in September and a January 1, 2004 effective date.

The Board considered its policy on visiting judges with regards to the Miscellaneous Class. There was a proposal to modify the policy. Following a motion by Dr. Davies, seconded by Mr. Goodman, it was VOTED (affirmative, Dr. Davies, Mr. Goodman, Mr. Gladstone, Dr. Garvin, Mrs. Schaefer, Ms. Scully, Mr. Marden, Mr. Menaker, Dr. Mays, Dr. Battaglia; opposed, Dr. Haines, Mr. Merriam; absent, Mrs. Strand) to consider the matter at this meeting, waiving the prior notice requirement. Following a motion by Mr. Goodman, seconded by Dr. Battaglia, it was VOTED(unanimously; absent, Mrs. Strand) to amend the policy to read as follows, effective immediately:

"Visiting Judges are not eligible to judge Junior Showmanship Classes at AKC events.

Visiting Judges eligible to judge a Group at AKC shows, are also eligible to be approved to judge the Miscellaneous Class."

The Board considered a staff request for an allocation of $13,361 to finance an AKC team to participate in the 2004 Crufts Obedience World Cup Competition. Following a motion by Ms. Scully, seconded by Mr. Merriam, it was VOTED (affirmative, Dr. Davies, Mr. Goodman, Mr. Gladstone, Dr. Garvin, Mr. Merriam, Mrs. Schaefer, Ms. Scully, Mr. Marden, Mr. Menaker, Dr. Mays, Dr. Battaglia; opposed, Dr. Haines; absent, Mrs. Strand) to consider the matter at this meeting, waiving the usual prior notice requirement. Following a motion by Ms. Scully, seconded by Mr. Goodman, it was VOTED (affirmative, Dr. Davies, Mr. Goodman, Mr. Gladstone, Dr. Garvin, Mr. Merriam, Mrs. Schaefer, Ms. Scully, Mr. Marden, Mr. Menaker, Dr. Haines, Dr. Battaglia; opposed, Dr. Mays; absent, Mrs. Strand) to approve the request.

The Events and Clubs Committee also discussed the Miscellaneous Class, the use of ramps in conformation judging, the Working Dog Sport, the FSS, and the Crufts Obedience World Cup Competition.

Mr. Merriam gave the report from the Business Committee. The committee had discussed superintendent license fees and a possible event secretary fee.

The committee also discussed event application fees. However, no changes were recommended.

Dr. Battaglia gave a report from the Operations and Planning Committee.

Following a motion by Dr. Battaglia, seconded by Dr. Garvin, it was VOTED (unanimously; absent, Mrs. Strand) to add the Belorussian Cynological Union to the list of registries with pedigrees acceptable for AKC registration.

Following a motion by Dr. Battaglia, seconded by Dr. Garvin, it was VOTED (unanimously; absent, Mrs. Strand) to add Asociacion Ecuatoriana De Registros Caninos (AERCAN) to the list of registries with pedigrees acceptable for AKC registration.

The Board reviewed Open Registration. Following a motion by Ms. Scully, seconded by Mrs. Schaefer, it was VOTED (unanimously; absent, Mrs. Strand) to reduce the Open Registration application fee to $15 effective September 1, 2003.

The committee also discussed Registered Kennel Names, a proposed amendment to the AKC Bylaws concerning the Nominating Committee, and the judging approval process.

Dr. Mays gave a report from the Public Relations and Public Affairs Committee.

The Public Relations and Public Affairs Committee requested an allocation of $11,500 to fund a "Lobby Day" in Washington, D.C. It would serve to strengthen AKC's federal government relations program. About 20 legislative liaisons from AKC clubs will be invited for a morning training session and afternoon meeting with members of Congress. Following a motion by Ms. Scully, seconded by Mr. Marden, it was VOTED (unanimously; absent, Mrs. Strand) to approve this allocation.

The committee also discussed AKC Canine Legislation Position Statements to address cloning, Guardian vs. Owner, and Homeowners' Insurance and Dangerous Dogs. The committee also discussed AKC's policy on Banners and Signs and the recommendations of the High Volume Breeders Committee.

Mr. Marden gave the report of the Pension Committee. In order to bring AKC's benefit package more in line with other companies, a number of changes were approved.

The Board considered a request from the German Shepherd Dog Club of Flint for approval of an event that was denied because of a conflict with an all-breed shows. The all-breed show as not willing to relinquish classes for German Shepherd Dogs because its Premium List had been mailed, but had no objection to the specialty being held within 200 air miles of its show. Following a motion by Mrs. Schaefer, seconded by Mr. Goodman, it was VOTED (affirmative, Mrs. Schaefer, Mr. Goodman, Mr. Merriam, Dr. Battaglia, Dr. Davies, Mr. Menaker, Mr. Gladstone, Ms. Scully, Dr. Haines, Mr. Marden; abstaining, Dr. Mays, Dr. Garvin; absent, Mrs. Strand) to approve the request as long as the all-breed club has no objection.

There was an Executive Session to discuss personnel matters. The Board returned from Executive Session.

Mr. Menaker reported on the hard work and extensive hours many on the management and administrative staff have been devoting to address the problems in the registration area. There was a motion by Dr. Garvin, seconded by Mr. Gladstone and it was VOTED (unanimously; absent Mrs. Strand) to express the Board's gratitude to all of the management and administrative staff that have worked so hard in this crisis, and their confidence that with the dedication of individuals like these, the inadequacies of the present system will be successfully addressed, and that the AKC will remain the preeminent registry for Purebred Dogs in the World.
