AKC Board Minutes

January 2003

The Board convened Monday, January 13, 2003 at 11:20 a.m. after the meetings of the various Board Committees. All Directors were present as were the Chief Operating Officer and Executive Secretary.

The Board reviewed the November 2002 minutes. Upon motion made by Mr. Goodman and seconded by Ms. Scully, the minutes of the November 2002 meeting, copies of which were made available to all Directors, were adopted as revised (unanimously).

The Chairman, Mr. Menaker, gave a report on the 2002 AKC/Eukanuba National Invitational Championship. Because of the time involved in planning for the annual Invitational and the surrounding activities, Mr. Menaker indicated that Kuno Spies had been hired to serve as the Invitational Coordinator.

The Board expressed its appreciation to Dr. Davies, Mr. Goodman and Mrs. Strand, the Board members on the Invitational Planning Committee, and to Ron Menaker and Al Cheauré, the Event Chairman and Assistant Chairman, for the work they did on the 2002 event.

The President, Mr. Cheauré, gave a personnel update.

Mr. Cheauré briefed the Board on the Internal Management Consulting Team.

Mr. Cheauré reported that AKC management has entered a licensing agreement with 4 Kids Entertainment, with an initial term of three years and limited to children's toys and quick service restaurants, e.g., an AKC toy in a fast food restaurant's children's meal. Among 4 Kids properties are Pokemon, Cabbage Patch Kids, Nintendo, and Yu-Gi-Oh.

Mr. Menaker gave a DOGNY auction update. The cumulative proceeds from the live and eBay online auctions are $174,495 to date. The remaining statues will be sold on eBay. All of the proceeds from the sale are going to the AKC CAR Canine Support and Relief Fund.

Mr. Cheauré reported on registration initiatives.

Mr. Stevens gave a financial update. The Financial Report for December 2002 showed an excess of expenses over revenue of $649,000.

The individual registration figures for December 2002 are 61,719 versus 66,585 for December 2001.

The litter registration figures for December 2002 are 32,080 versus 34,168 for December 2001.

There was a discussion on the Special Reserves for 2003. Following a motion b Dr. Battaglia, seconded by Mr. Menaker, it was VOTED (unanimously) to approve the following reserves for 2003:

The Board reconsidered the moratorium on the registration of Greyhounds based upon a National Greyhound Association pedigree. The moratorium was imposed in January 2002, while the Board considered a request from the Board of the Greyhound Club of America to remove the National Greyhound Association from the list of organizations with pedigrees acceptable for AKC registration. In October 2002, the AKC Board developed criteria and a procedure to handle such requests. Following a motion by Mr. Marden, seconded by Ms. Scully, it was VOTED (affirmative, Mr. Marden, Ms. Scully, Mr. Merriam, Mr. Kelly, Mrs. Strand, Dr. Davies, Dr. Mays, Dr. Battaglia, Mr. Goodman, Mr. Gladstone, Mrs. Schaefer, Mr. Menaker; opposed, Dr. Garvin) to remove the moratorium. If a future request is received from the Greyhound Club of America, it will be processed in accordance with the Board-approved procedure.

Mr. Hayes and Ms. Ford, staff, were present via video conference for discussion of items pertaining to judging.

Dr. Davies, Mr. Gladstone and Mr. Marden, members of the Appeals Committee, left the meeting prior to the report on Judges Applications.

Following completion of the report on Judges Applications, Dr. Davies, Mr. Gladstone and Mr. Marden returned to the meeting.

The Board considered proposed clarifications to the Discipline Guidelines as they pertain to misconduct against a judge. The matter was to be discussed further in February.

There was a report on the actions taken by the AKC staff during the month of December 2002 on the cancellation of litters and individual registrations.

During the month of December, the registrations of 40 litters were cancelled: 31 because of DNA Parentage Evaluation and 9 because of impure breeding.

The cancellation of the 40 litters resulted in the cancellation of 49 registered dogs and rendered 134 dogs, members of these litters, ineligible for registration.

The following actions taken by the AKC Management Disciplinary Committee were reported:

Richard Black (Elsie, MI) was suspended by the South Michigan Weimaraner Club for conduct at its event on October 20, 2002. Specifically, Mr. Black was charged with using abusive and foul language. The AKC Management Disciplinary Committee acted to suspend Mr. Black from all event privileges for one month, effective October 20, 2002, and imposed a $500 fine.

Laural Cain (Hemet, CA) was suspended by the Tucson Kennel Club for conduct at its event on November 17, 2002. Specifically, Ms. Cain was charged with having a physical altercation; impairing a club's ability to retain a site; disruptive behavior at an event and neglect of a dog in connection with an event. The AKC Management Disciplinary Committee acted to suspend Ms. Cain from all event privileges for a period of six months, effective November 17, 2002, and imposed a $300 fine.

Mark Denk (Apple Valley, CA) was suspended by the Tucson Kennel Club for conduct at its event on November 17, 2002. Specifically, Mr. Denk was charged with having a physical altercation; using foul and abusive language; impairing a club's ability to retain a site and disruptive behavior at an event. The AKC Management Disciplinary Committee acted to suspend Mr. Denk from all event privileges for a period of six months, effective November 17, 2002, and imposed a $300 fine.

Gary Haupt (Thornton, CO) was suspended by the Evergreen Colorado Kennel Club for conduct at its event on November 9, 2002. Specifically, Mr. Haupt was charged with using abusive and foul language. The AKC Management Disciplinary Committee acted to suspend Mr. Haupt from all event privileges for one month, effective November 9, 2002, and imposed a $500 fine.

Kathleen Miller (Sebastopol, CA) was suspended by the Sacramento Valley Dog Fanciers Association for conduct at its event on October 29, 2002. Specifically, Ms. Miller was charged with mistreatment of a dog in connection with an event. The AKC Management Disciplinary Committed acted to issue a public reprimand and imposed a $100 fine.

The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective January 13, 2003 and imposed a $2000 fine each for having refused to permit an inspection of records and practices, as provided by Chapter 4, Section 7 of the Rules Applying to Registration and Discipline:

The AKC's Management Disciplinary Committee has suspended the following individual from all AKC privileges for a period of ten years, effective January 13, 2003, and imposed a $2000 fine for conduct considered prejudicial to the best interests of purebred dogs in connection with the conviction as indicated:

Theresa M. Schroeder (N. Royalton, OH) - based on her conviction of Animal Cruelty in Parma Municipal Court, State of Ohio. (Labrador Retriever)

The AKC's Management Disciplinary Committee has suspended R. Theodore Baer (Indianapolis, IN) from all AKC registration privileges for a period of three months, effective January 13, 2003, and imposed a $500 fine for having submitted, or caused to be submitted, a litter registration application which he knew, or should have known, did not contain the personal signature of the co-owner of the litter and no POA form was on file. (Multiple Breeds)

The AKC's Management Disciplinary Committee has suspended Shirley Freeman (Powderly, TX) from all AKC privileges for a period of one year, effective January 13, 2003, and imposed a $1000 fine for failure to maintain her dogs and facilities in a manner acceptable to The American Kennel Club. (Multiple Breeds)

The AKC's Management Disciplinary Committee has suspended Sherry Kidwell (Kingsport, TN) from all AKC privileges for a period of ten years, effective January 13, 2003, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and identification and failure to maintain her dogs and facilities in a manner acceptable to The American Kennel Club. (Chinese Shar-Pei)

The AKC's Management Disciplinary Committee has suspended Paul Lutz (Greentown, PA) from all AKC privileges for a period of six months, effective January 13, 2003, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications, which he knew, should have known, or had a duty to know, contained exclusions. The Board considered an amendment to the italicized portion of Chapter 9, Section 12 and Chapter 11, Section 12 of the Rules Applying to Dog Shows, which governs when and where a superintendent may exhibit. The current regulation is so restrictive that it would virtually make it impossible for any employee of a superintending organization to exhibit at shows superintended by another organization. Under the proposal, superintendents would be placed under restrictions similar to those imposed on dog show judges. The identical wording now appears at the end of both Chapter 9, Section 12 and Chapter 11, Section 12. Following discussion, staff was directed to refer the matter to the Delegate Dog Show Rules Committee for input. Besides the substantive changes, the Board had some concern that the italicized verbiage goes beyond the rule and might more properly be handled through a rule change.

The Board considered a staff proposal for the registration of the Nova Scotia Duck Tolling Retriever and for its eligibility to compete in the Sporting Group. Following a motion by Ms. Scully, seconded by Mrs. Strand, it was VOTED (affirmative, Ms. Scully, Mrs. Strand, Mr. Menaker, Mr. Kelly, Dr. Davies, Dr. Mays, Mr. Marden, Mr. Goodman; opposed, Mr. Merriam, Dr. Garvin, Mr. Gladstone, Mrs. Schaefer, Dr. Battaglia) to consider the matter at this meeting, waiving the usual prior notice requirement. Following a motion by Dr. Davies, seconded by Ms. Scully, it was VOTED (unanimously) to approve the registration of the Nova Scotia Duck Tolling Retriever, effective May 1, 2003, and its eligibility to compete in the Sporting Group July 1, 2003. An open registry for the breed will be maintained until December 31, 2005.
The above changes are effective January 31, 2003.

The Board considered amendments to Chapter 1, Sections 3 and 15 of the Obedience Regulations, Chapter 1, Section 5 of the Tracking Regulations and Chapter 1, Section 11 of the Agility Regulations. These amendments were necessary because of amendments adopted to the Rules Applying to Dog Shows. Following a motion by Ms. Scully, seconded by Mrs. Strand, it was VOTED (affirmative, Ms. Scully, Mrs. Strand, Dr. Davies, Mr. Kelly, Mrs. Schaefer, Mr. Goodman, Dr. Mays, Dr. Battaglia, Mr. Gladstone, Mr. Marden; opposed, Mr. Merriam, Dr. Garvin, Mr. Menaker) to consider the matter at this meeting, waiving the usual prior notice requirement.

Following a motion Dr. Garvin , seconded by Ms. Scully, it was VOTED (unanimously) to approve the amendments, effective March 10, 2003.

Obedience Regulations
Add a new Chapter 1, Section 3, renumbering Sections 3 through 34, as 4 through 35, and amend Chapter 1, Section 15 (now Section 16l), so they will read as follows:

Chapter 1, New Section 3: Entries.

To be acceptable, an entry must:

  • Be submitted with required entry fee
  • Be on an Official American Kennel Club entry form
  • Be signed by the owner or his duly authorized agent

Include all of the following information:

  • Name of show/trial-giving club
  • Date of show/trial
  • Breed
  • Variety, if any
  • Sex
  • Name of class(es) entered
  • Full/Registered name of dog
  • Name of owner(s)/co-owner(s)
  • Address of owner

Include one of the following:

  • AKC Registration number, or
  • AKC litter number, or
  • ILP number, or
  • Foreign registration number and country for an unregistered imported dog, or
  • Identification number issued by AKC

Include the following, if known:

  • Date of birth
  • Place of birth
  • Name of breeder(s)
  • Name of sire
  • Name of dam

Section 15 (now Section 16). When titles are won.
After a dog earns a title, it may continue showing in that class for 60 days.
A dog may compete in a more advanced class if it receives the prerequisite title before the closing date of the trial in which the advanced entry is to be made. Once a dog is entered in Open under this section, it may not again be shown in Novice A, and a dog entered in Utility under this section, may not be shown in Open A.

Tracking Regulations
Amend Chapter 1, Section 5 to read as follows:
Chapter 1, Section 5. Dog Show Rules and Obedience Regulations.

The Obedience Regulations and Dog Show Rules, where applicable, shall govern the conduct of tracking tests and shall apply to all persons and dogs participating in them, except as these Tracking Regulations may otherwise provide.

The sections of Obedience Regulations that apply directly to tracking tests are:

Section 3 (Entries)
Section 4 ( now Section 5) (Tracking Tests)
Section 10 (now Section 11) (Immediate Family)
Section 11 (now Section 12) (Purebred Dogs Only)

Section 16 (now Section 17) (Disqualification, Ineligibility, Excusal and Change in Appearance of Dogs)

Agility Regulations
Amend Chapter 1, Section 11 to read as follows:

To be acceptable, an entry must:

  • Be submitted with required entry fee
  • Be on an Official American Kennel Club entry form
  • Be signed by the owner or his duly authorized agent

  • Date of show/trial
  • Breed
  • Variety, if any
  • Sex
  • Name of class(es) entered
  • Full/Registered name of dog
  • Name of owner(s)/co-owner(s)
  • Address of Owner

  • AKC litter number or

  • Foreign registration number and country for an unregistered imported dog, or
  • Identification number issued by AKC

Include the following, if known:

No entry may be accepted unless the Superintendent or Show/Trial Secretary, named in the premium list to receive entries, receives such entry:

Prior to the closing date and hour as published in the premium list, and
In the case of a limited entry, prior to the time the limit is reached.

All the requirements of the foregoing paragraph and all other specific requirements printed in the premium list must be met before an entry can be considered acceptable.

The committee also discussed the enforcement of judges contracts, the performance of a dog show superintendent, revisions to the Pointing Breed and Spaniel Field Trial Rules, the National Obedience Invitational and the National Agility Invitational.
Mr. Merriam gave the report for the Board Business Committee.

There was a discussion on the Supplemental Registration Transfer fee. In 1999, this fee had been raised from $4.00 to $10.00, and subsequently to $15.00. As a result, there has been a dramatic decline in the number of supplemental transfer applications received. In an effort to reverse this trend, management recommended a fee decrease to $5.00, effective April 1, 2003. Following a motion by Mr. Gladstone, seconded by Mrs. Schaefer, it was VOTED (unanimously) to adopt the staff recommendation.

The Business Committee also discussed the Compliance Division budget and the PricewaterhouseCoopers report on the Events Division.

Dr. Battaglia gave the report for the Board Operations and Planning Committee.

Following a motion by Dr. Battaglia, seconded by Dr. Garvin, it was VOTED (unanimously) to add the Estonian Kennel Union, the Kennel Club of Thailand and the Kennel Association of Sri Lanka to the list of organizations with pedigrees acceptable for AKC registration.

The Operations and Planning Committee also discussed the judging approval procedures, kennel name policy, a possible Bylaw amendment to allow for more flexible scheduling of the fourth quarterly Delegate meeting. The committee had reviewed, but taken no action, on a request from the Newfoundland Club of America to make all registrations limited unless a full registration was specifically requested.

Mrs. Strand gave the report for the Board Public Relations and Public Affairs Committee.

The Public Relations and Public Affairs Committee discussed the Corporate ID Guidelines Program, 2003 advertising, the establishment of an official AKC Responsible Dog Ownership Day.

Mr. Marden reported that the Pension Committee, based on a New York Life recommendation, unanimously approved lowering the discount rate on the AKC Pension Plan to 6.75%.

There was a workshop to discuss the PricewaterhouseCoopers report on the Events Department.
