AKC Board Minutes
October 2002

The Board convened Monday, October 7, 2002 at 11:20 a.m. after the meetings of the various Board Committees. All Directors were present as were the Chief Operating Officer and Executive Secretary.

The Board reviewed the August 2002 minutes. Upon motion made by Ms. Scully and seconded by Dr. Mays, the minutes of the August 2002 meeting, copies of which were made available to all Directors, were adopted (unanimously).

The Chairman, Mr. Menaker, reported on a request from the annually licensed superintendents for a meeting and that Mr. Merriam, Mr. Gladstone, and himself were to meet with representatives of the superintendents on the Wednesday following the meeting.

There was an Executive Session to discuss business and personnel matters

Mr. Menaker reported on the AKC/Eukanuba National Invitational Championship. For the 2003 event in Long Beach, CA, the qualification period was extended to twelve months (October 8, 2002 - October 7, 2003). The top dog in each country with a registry that issues pedigrees acceptable for AKC registration, for each AKC registrable breed, will also be eligible to be invited. The criteria for selecting the top dog in each eligible breed in each country will be left to the registry in that country if it wishes to participate.

As Board attendance at different types of AKC events around the country is both desirable and important, and as the Board allowance for such travel has not increased for six years despite rising costs, It was agreed that effective immediately, a Director may be reimbursed not more than $6,000 in a year, to cover actual expenses for attending AKC events.

Mr. Cheauré reported on a "Best in Service" strategy being developed by the North Carolina staff to expand AKC's ability to provide a new level of service to its customers. It involves developing a set of clearly stated customer-centered service principles and goals, a skill-based training program and divisional follow-up strategies.

Mr. Cheauré reviewed the AKC Banner program expansion, which includes the cooperative efforts of major dog show photographers and dog food companies.

Mr. Cheauré reported that the AKC Mini Agility Team won the silver medal at the World Agility Championship and that a member of the AKC Mini Team won the individual gold medal.

Mr. Stevens gave a financial update. The Financial Report for September 2002 showed an excess of expenses over revenue of $174,000.

The individual registration figures for September 2002 are 77,029, versus 82,381 for September 2001.

The litter registration figures for September 2002 are 35,745 versus 29,937 for September 2001.

The Board reviewed matters discussed at the September 2002 retreat.

Meeting reconvened Tuesday, October 8, 2002 at 8:00 a.m. All Directors were present, as were the Chief Operating Officer and Executive Secretary.

Mr. Slay, staff, participated via video conference in the portion of the meeting dealing with disciplinary actions.

There was a report on the actions taken by the AKC staff during the month of September 2002 on the cancellation of litters and individual registrations.

During the month of September, the registrations of 44 litters were cancelled: 16 because of impure breeding and 28 because of DNA Parentage Evaluation.

The cancellation of the 44 litters resulted in the cancellation of 59 registered dogs and rendered 149 dogs, members of these litters, ineligible for registration.

The following actions taken by the AKC Management Disciplinary Committee were reported:

Kathryn Kirk (Oxford, CT) was suspended by the Bennington County Kennel Club for conduct at its event on August 11, 2002. Specifically, Ms. Kirk was charged with mistreatment of her dog. The AKC Management Disciplinary Committee acted to suspend Ms. Kirk for a period of one month, effective August 11, 2002, and imposed a $300 fine.

The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective October 7, 2002, and imposed fines of $2000 each for failure to comply with the recordkeeping and identification requirements of Chapter 4 of the Rules Applying to Registration and Discipline. Further, reinstatement will be contingent upon their beginning with a new colony:

The AKC's Management Disciplinary Committee has suspended Magda Aguila (Greenville, SC) from all AKC privileges for a period of five (5) years, effective October 7, 2002, and imposed a $1000 fine for having submitted, or caused to be submitted, a litter registration application, which she knew, contained false certifications as to the dam of the litter. The AKC's Management Disciplinary Committee has suspended Maurine Barnett (Joshua, TX) from all AKC privileges for a period of ten (10) years, effective October 7, 2002, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and identification and failure to maintain her dogs and facilities in a manner acceptable to The American Kennel Club. (Multiple Breeds)

The AKC's Management Disciplinary Committee has suspended Sally Butts (Salem, MO) from all AKC privileges for a period of six (6) months, effective October 7, 2002, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications, which she knew, should have known, or had a duty to know, contained false certification. (Weimaraner)

The AKC's Management Disciplinary Committee has suspended Mark Mann (Cement City, MI) from all AKC privileges for a period of ten (10) years, effective October 7, 2002, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and identification and failure to maintain his dogs and facilities in a manner acceptable to The American Kennel Club. (German Shepherd Dog)

The AKC's Management Disciplinary Committee has suspended Anna McDonald (Crane, MO) from all AKC privileges for a period of ten (1o) years, effective October 7, 2002, and imposed a $2000 fine for failure to maintain her dogs and facilities in a manner acceptable to The American Kennel Club, and failure to comply with the rules and regulations for recordkeeping and identification. (Cocker Spaniel and Dachshund)

The AKC's Management Disciplinary Committee has suspended Diana Owens (San Dimas, CA) from all AKC privileges for a period of two (2) years, effective October 7, 2002, and imposed a $2000 fine for failure to provide records when requested and for having submitted, or caused to be submitted, litter registration applications and subsequent registration applications, which she knew, or should have known, did not contain the personal signature of the litter owner. Following a motion by Mrs. Strand, seconded by Mrs. Schaefer, it was VOTED (unanimously) to approve the breed standard revisions proposed by the Gordon Setter Club of America, as published in the GAZETTE. The effective date is November 27, 2002.

The Board considered the policy governing special attractions.

At its June 12, 1990 meeting, the AKC Board of Directors voted: "to prohibit any club which is eligible to hold AKC events from sponsoring any type of activity in which a dog is expected to act in an aggressive manner towards a person. This would include Schutzhund, as well as any other activity involving the biting, grabbing or attacking of a person; and that failure to comply with this policy will result in the revocation of a club's show and/or trial privileges."

The above policy resulted from AKC's long and costly battle against breed specific, anti-vicious dog legislation. The events of September 11, 2001, have changed everyone's perspectives and focus. Whether it be protecting vital facilities, detecting dangerous substances, or finding and rescuing survivors and recovering the victims of terrorist attacks, the role of the intensely trained human/canine team in contributing to Homeland Defense has never been more apparent. That is why AKC is exploring the establishment of our AKC Working Dog Sport, which would unify components of other AKC activities like Obedience, Tracking, and Agility into exercises that would enable dogs to demonstrate characteristics and skills that could, with additional training, make them potentially useful in Homeland Defense.

Following a motion by Mr. Marden, seconded by Ms. Scully, it was VOTED (unanimously) to add the following qualification to the Board policy:

"This policy would not preclude special attraction by uniformed police or military units, where dogs are demonstrating the skills necessary for law enforcement and/or homeland defense."

The Board considered an appeal from the Blue Grass Boxer Club to a staff denial of a Thursday evening specialty show on the same day as an all-breed show seventy-seven miles away. There was a motion by Mrs. Schaefer, seconded by Ms. Scully, to approve the appeal, that was defeated, with the VOTE (affirmative, Mrs. Schaefer, Ms. Scully; opposed, Mr. Merriam, Mr. Menaker, Mrs. Strand, Mr. Goodman, Mr. Kelly, Mr. Gladstone, Dr. Garvin, Dr. Mays, Mr. Marden, Dr. Battaglia, Dr. Davies). There was a motion by Mr. Menaker, seconded by Mr. Goodman, and it was VOTED (affirmative, Dr. Battaglia, Dr. Davies, Mr. Menaker, Mr. Goodman, Mr. Marden, Dr. Mays, Dr. Garvin, Mr. Kelly, Mrs. Strand, Mr. Merriam, Mr. Gladstone; opposed, Mrs. Schaefer, Ms. Scully) to deny the appeal.

The committee also discussed show-related revenue enhancements and the enforcement of contracts between clubs and judges.

Mr. Merriam gave the report for the Business Committee.

There was a discussion on ILP fees. Currently there is no fee for issuing a transfer or a duplicate ILP certificate although there is just as much work and cost involved as for the same services for a registered dog. Following a motion by Mr. Merriam, seconded by Mrs. Strand, it was VOTED (unanimously) to initiate a $10 fee for recording the transfer of an ILP dog or for the issuance of a duplicate ILP certificate.

The Business Committee also discussed the concept of an AKC general interest magazine, AKC Family Dog.

Dr. Battaglia gave the report for the Operations and Planning Committee.

The Board discussed the protest to the registration of the Terrydale kennel name to Maripi Wooldridge and Jennifer Stevens in November 1999. The protest was lodged by Mary Clark, who had used the name from 1984 until 1994. In 1997, she went into a collaborative breeding program with Dr. Gerardo Reyes and used "Reydale Terrydale" in the name of a number of dogs. After "Terrydale" was registered, Mrs. Clark and Dr. Reyes were able to use "Reydaleterrydale" as one word in naming dogs, as AKC only protects registered names used as separate and distinct words. When entries were made separately with the words "Reydale" and "Terrydale" on the entry forms, Dr. Reyes was advised that the word "Reydaleterrydale" could no longer be used. The protest to the granting of the kennel name followed. Following a motion by Dr. Battaglia, seconded by Mrs. Strand, it was VOTED (unanimously, except for Mr. Gladstone abstaining):

1. That the registered name approval stand, as it has been used as such for 3 yrs.

2. That Mrs. Clark and Dr. Reyes be permitted to continue to use Reydaleterrydale in naming dogs as long as it is used as one word in all cases, which is what they were advised in August 2001. This would be consistent with how every other kennel name is treated.

Following a motion by Mr. Goodman, seconded by Mr. Merriam, it was VOTED (unanimously) to approve a change in breed name from the Jack Russell Terrier to the Parson Russell Terrier, with the name of the AKC Parent Club accordingly changed to the Parson Russell Terrier Association of America. The change will take effect April 1, 2003.

The Board considered the adoption of a procedure to handle Parent Club requests to open or close the registry. Following a motion by Dr. Battaglia, seconded by Ms. Scully, it was VOTED (unanimously) to adopt the following guidelines:

GUIDELINES FOR OPENING OR
CLOSING THE AKC STUD BOOK

AUTHORITY
The Bylaws of The American Kennel Club do give the AKC Board of Directors the authority and ultimate responsibility over all matters pertaining to the AKC registry. However, when stud book issues affecting only one breed are at issue, the AKC Board has always given great weight to the input of the breed Parent Club.

AKC has from time to time received requests from Parent Clubs to open or to close the stud book to dogs with pedigrees from registries other than AKC in the United States. Guidelines have been established to handle these requests.

THE REQUEST
When the Board of a breed Parent Club wishes to have the AKC stud book for its breed opened or closed, a formal request must be sent in writing to the AKC Executive Secretary. It must include:

A. A justification, and the Parent Club Board's assessment as to whether the need is desirable, important or critical for the welfare of the breed.

B. A summary of any arguments against the proposal of which the club is aware.

C. A sample of a ballot the club would propose to use and an explanation of the procedure the club intends to use in conducting a vote of its members.

The justification should be as specific as possible, and may include, but is not limited to such factors as:

A. Gene Pool Diversity
If the gene pool lacks quality specimens, or is overly inbred, resulting in genetic problems, this must be documented. The club's long and short-term strategic plan must be explained along with what educational initiatives the club would undertake.

B. Too Few Dogs Registered With AKC
If this reason is given, the club must specify how many dogs it would expect to be registered with AKC and the basis of this expectation. As above, the club must document its long and short-term plan to encourage breeders and owners to register their dogs with AKC.

C. Health
This must include documented scientific evidence that a problem exists, it is getting worse, and that there is a potential solution. Any studies cited must be credible and widely accepted.

D. Other Reason
Any reason must include details on how the addition of dogs would improve the breed or address a specific problem. It should include the club's strategic plan to attract dogs to the AKC registry and to encourage breeding to these dogs.

THE PROCESS
The request from the Board of the Parent Club would be reviewed by the AKC Board. If, in the opinion of the AKC Board it appears to have merit, the Parent Club will be advised to proceed
with a ballot of its entire membership. Following said ballot, the club must submit the following to the AKC Executive Secretary:

A. The results of the ballot. An affirmative vote of 2/3 of those voting would be required for
AKC to consider the request.

B. A certification that the vote followed the procedures proposed by the club when the
original request was made.

An affirmative vote of 2/3 of the club's membership does not bind the AKC Board to acceptance of the club proposal as the ultimate responsibility for the registry does rest with the AKC Board.

Once the stud book for a breed has been opened or closed, another request to open or close the stud book for the same breed will not be entertained for five years from the date of the Board action.

Dr. Mays moved that any pending breed-specific requests be voided until complying with the above policy. There was no second.

There was a motion by Mr. Marden, seconded by Dr. Mays, to remove the current moratorium on registering National Greyhound Association Greyhounds. There was a motion by Mr. Gladstone, seconded by Dr. Garvin, and it was VOTED (affirmative, Mr. Gladstone, Dr. Garvin, Mr. Kelly, Dr. Battaglia, Ms. Scully, Mr. Menaker, Mr. Merriam, Mr. Goodman; opposed, Mr. Marden, Dr. Mays, Mrs. Schaefer, Dr. Davies, Mrs. Strand) to table this motion.

Following a motion by Mr. Goodman, seconded by Mrs. Schaefer, it was VOTED (unanimously) to add the Kennel Club of Greece to the list of registries with pedigrees acceptable for AKC registration.

The Operations and Planning Committee also discussed requirements for registered kennel names, the addition of the Kennel Club of Pakistan to the list of registries with pedigrees acceptable for AKC registration, and modifications to the judges application procedures and requirements.

Mrs. Strand gave the report of the Public Relations and Public Affairs Committee. The Board was shown three videos. The first was a 30-second video, "Beyond the Sport," which is currently being aired on the Lifetime Channel. The second, "Superstars," will run in Houston for the AKC Agility Championships and will be available for club use. The third consisted of 20, 30, and 60-second P.S.A.'s being sent to over 500 TV stations and 250 radio stations.

Mrs. Strand reviewed the positive media coverage received throughout the U.S., as well as England, Japan, Russia, China, and Germany as a result of the DOGNY initiative.

The Public Relations and Public Affairs Committee will continue to review the AKC web site and possible topics for future P.S.A.'s.

Mr. Gladstone reported on alternate registries.

There being no further business to come before the meeting, and upon motion made
and seconded, it was
