AKC Board Minutes

July 2002

The Board convened Monday, July 8, 2002 at 11:30 a.m. after the meetings of the various Board Committees. All Directors were present as were the Chief Operating Officer and Executive Secretary.

The Board reviewed the May 2002 minutes. Upon motion made by Mr. Goodman, and seconded by Dr. Battaglia, the minutes of the May 2002 meeting, copies of which were made available to all Directors, were adopted (unanimously).

The Chairman, Mr. Menaker, reviewed correspondence referred to him as Chairman.

Mr. Menaker gave an update on the DOGNY project. By August 15, the statues should be on the streets of New York and the August 24, 2002 DOGNY Day at Yankee Stadium has been reaffirmed.

Mr. Menaker reported the recipients of the AKC Veterinary Scholarship awards for 2002-2003. There was a total of $160,000 presented to twenty-three students who each received between $5,000 and $15,000. The recipients are:

There was a discussion on the display of banners and signs at AKC events. Following a motion by Mr. Gladstone, seconded by Ms. Scully, it was VOTED (unanimously) to adopt the following policy, with clubs and/or superintendents to be fined $300 for noncompliance, effective immediately:

All Clubs using an AKC licensed superintendent and those superintendents must display banners and signs provided by AKC to those superintendents at their shows. The banners and signs containing the AKC logo must be placed in prominent and highly visible areas. The banners must be hung on visible walls under tents at outdoor shows and directly on show rings. The signs must also be in highly visible areas, such as near a busy show entrance, near catalog sales points, one near the Best in Show ring during judging and as part of the backdrop for the show photographer. The Superintendent and the show-giving club are responsible for coordinating the placing of the banners and signs.

Clubs that are not using the services of a Superintendent are strongly encouraged to display AKC banners and signs at their event. These banners and signs may be purchased from AKC. Inquiries may be directed to:

The Board reviewed the artist's concept for a painting the Board commissioned to commemorate September 11, 2001. The artist is Charlotte Sorré.

The President, Mr. Cheauré, gave an update on the Intern Program. Mr. Cheauré gave a personnel update.

Mr. Stevens gave a financial update. The Financial Report for June 2002 showed an excess of expenses over revenue of $298,000.

The individual registration figures for June 2002 are 79,858 versus 93,058 for June 2001.

The litter registration figures for June 2002 are 37,524 versus 43,648 for June 2001.

The Executive Secretary, Mr. Crowley, reported on a request from the Canadian Kennel Club concerning an extension of the reciprocal agreements between AKC and CKC. Currently AKC will provide material for CGC tests in Canada, and dogs owned by residents of Canada would be eligible to apply for ILP numbers. This was done in the past because the Canadian Kennel Club had no CGC program or ILP.

CKC has instituted a Canine Good Neighbor (CGN) program which mirrors the AKC CGC program and a Performance Event Number (PEN) which mirrors the AKC ILP.

Following a motion by Mrs. Strand, seconded by Mr. Gladstone, it was VOTED (unanimously) that effective August 1, 2002, no dog owned by a resident of Canada may be issued an ILP unless it has first been issued a PEN by CKC and no CGC kit shall be sent to any group in Canada. Any inquiries from groups in Canada will be referred to the CKC.

Mr. Crowley reported on a catalog and poster for the exhibit of AKC and AKC Museum artwork at the Orlando Museum of Art in late 2002. The production cost for both is $24,500.

Mr. Marden, Dr. Davies and Mr. Gladstone, members of the Appeals Committee, left the meeting prior to the report on Judges Applications.

Following completion of the report on Judges Applications, Mr. Marden, Dr. Davies, and Mr. Gladstone returned to the meeting.
Mr. Slay, staff, participated in the portion of the meeting dealing with disciplinary actions.

There was a report on the actions taken by the AKC staff during the month of June 2002 on the cancellation of litters and individual registrations.

During the month of June, the registrations of 29 litters were cancelled: 10 because of impure breeding, 17 as a result of the Compliance Audit Program - DNA, and 2 at the request of the litter owner(s).

The cancellation of the 29 litters resulted in the cancellation of 38 registered dogs and rendered 110 dogs, members of these litters, ineligible for registration.

The following actions taken by the AKC Management Disciplinary Committee were reported:

Cathy De Stout (Lakewood, CA) was suspended by the Antelope Valley Kennel Club for conduct at their event on May 26, 2002. Specifically, Ms. De Stout was charged with using foul and abusive language. The AKC Management Disciplinary Committee acted to issue a public reprimand and imposed a $100 fine.

Susanne Trabke (Fairbanks, AK) was suspended by the Tanana Valley Kennel Club for conduct at their event on May 26, 2002. Specifically, Ms. Trabke was charged with mistreatment of an animal in connection with an event. The AKC Management Disciplinary Committee acted to suspend Ms. Trabke of all privileges of the AKC for a period of one month, effective May 27, 2002, and imposed a $300 fine.

Patricia Lane (Hemet, CA) was suspended by the San Gabriel Kennel Club for conduct at their event on May 24, 2002. Specifically, Ms. Lane was charged with verbal abuse. The AKC Management Disciplinary Committee acted to suspend Ms. Lane of all AKC event privileges for a period of one month and imposed a $500 fine.

Lynn Geyer (N. Webster, IN) was suspended by the Kalamazoo Kennel Club for conduct at their event on May 26, 2002. Specifically, Ms. Geyer was charged with neglect of a dog in connection with an event. The AKC Management Disciplinary Committee acted to suspend Ms. Geyer of all AKC privileges for a period of three months, effective May 26, 2002, and imposed a $500 fine.

Nancy Gauthier (Andover, MA) was suspended by the Tracking Club of Massachusetts for conduct at their event on May 5, 2002. Specifically, Ms. Gauthier was charged with disruptive public criticism of a judge. The AKC Management Disciplinary Committee acted to suspend Ms. Gauthier from all AKC event privileges for a period of three months, effective May 20, 2002, and imposed a $300 fine.

Angel White (Mentore, CA) was suspended by the Kennel Club of Pasadena for conduct at their event on June 1, 2002. Specifically, Ms. White was charged with mistreatment of a dog in connection with an event. The AKC Management Disciplinary Committee acted to suspend Ms. White from all AKC privileges for a period of one month, effective June 1, 2002, and imposed a $300 fine.

Dr. Charles Rogers (Sandy, UT) was involved in an incident which occurred at the Flagstaff Kennel Club event on June 9, 2002. Specifically, Dr. Rogers was charged with using foul and abusive language. The AKC Management Disciplinary Committee acted to issue a public reprimand and impose a $100 fine.

Sol Semmler (Chancellor, SD) was suspended by the Nebraska Dog and Hunt Club for conduct at their event on April 28, 2002. Specifically, Mr. Semmler was charged with mistreatment of his animal. The AKC Management Disciplinary Committee acted to issue a public reprimand and imposed a $100 fine.

Lowell Starner (Tannersville, PA) was suspended by the SouthEastern Brittany Club for conduct at their event on March 2, 2002. Specifically, Mr. Starner was charged with using foul and abusive language. The AKC Management Disciplinary Committee acted to suspend Mr. Starner for one month, effective April 19, 2002, and imposed a $500 fine.

The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective July 8, 2002, and imposed fines of $2000 each for failure to comply with the recordkeeping and identification requirements of Chapter 4 of the Rules Applying to Registration and Discipline. Further, reinstatement will be contingent upon their beginning with a new colony:

Following a motion by Ms. Scully, seconded by Mrs. Strand, it was VOTED (unanimously) to approve the amendments to the Smooth Fox Terrier breed standard, as published in the GAZETTE, with the changes effective August 28, 2002.

The committee also considered the circumstances under which a club's unused date should be protected, the Working Dog Sport concept, and the policy on approving special attractions, and possible statutes of limitations for appealing the cancellation of awards.

Mr. Merriam gave the Business Committee report.

There was a discussion on recovering of at least a portion of the cost of AKC services and products provided to its constituents and customers. Following a motion by Mr. Merriam, seconded by Ms. Scully, it was VOTED (unanimously) to adopt the following statement of intent:

"It is the intent and goal of the Board of Directors to evaluate the cost of the various services and products provided to AKC's constituents and customers and to determine the feasibility, advisability, and fairness of assessing reasonable costs to the ultimate users."

The Board reviewed strategy for the investment of AKC's operating funds. In August, the Board will consider a proposal that the AKC operating funds would be invested by the CFO, with the concurrence of the CEO and General Counsel and that the Board would be given notice of all such investments.

There was a discussion on the need for a cost analysis in the Event Operations area. Following a motion by Mr. Marden, seconded by Dr. Garvin, it was VOTED (unanimously) to approve the hiring of PricewaterhouseCoopers to:

  • Provide an external perspective, based on general business knowledge, best practices and relevant benchmark comparisons to identify issues/opportunities
  • Provide tools and frameworks for evaluating alternatives
  • Provide business case structure and manage business case development
  • Provide implementation plan for recommendations
  • High level operating model
  • Action items
  • Cost/benefit analysis
  • High level tactical migration and implementation options including resource requirements

Dr. Battaglia gave the report for the Operations and Planning Committee.

Following a motion by Dr. Battaglia, seconded by Dr. Garvin, it was VOTED (unanimously) to add Ceskomoravskà Kynbologickàunie (Czech Republic) and Slovenskà Kynologicà Jednotà (Slovak Republic) to the list of registries with pedigrees acceptable for AKC registration.

The committee also discussed kennel names, breed specific stud book issues, a breed name change request from the Jack Russell Terrier Association of America and a possible change in the official AKC entry form.

Mrs. Strand gave the report for the Public Relations and Public Affairs Committee. The committee discussed the AKC image campaign, DOGNY, and upcoming legislative initiatives. Dr. James Holt and Noreen Baxter had discussed legislative strategies for the future with the committee.

Meeting reconvened Tuesday, July 9, 2002 at 8:05 a.m. All Directors were present. The Chief Operating Officer and Executive Secretary were also present.

The Board considered an appeal from the Chicago Goldcoast Kennel Club for permission to hold back-to-back shows at a site within the territory of a member all-breed club without that member club's permission. Following a motion by Mr. Marden, seconded by Mr. Goodman, it was VOTED (unanimously) to vote on this matter at this meeting, waiving the usual prior notice requirement. Following a motion by Mr. Merriam, seconded by Mr. Goodman, it was VOTED (affirmative, Mr. Merriam, Mr. Goodman, Dr. Battaglia, Dr. Garvin, Mr. Kelly, Ms. Scully, Mr. Marden; opposed, Mrs. Schaefer, Mr. Menaker, Mr. Gladstone, Dr. Davies; abstaining, Dr. Mays, Mrs. Strand) to deny the appeal.

There was a discussion of moving Delegate meetings to Monday. There was a consensus that, as many Delegates probably had commitments for 2003, consideration should be given to trying Monday meetings for one or more meetings in 2004. The Board members were given the 2004 dates involved and asked to send their input on possible changes for Delegate meetings in that year.

There was a workshop where developments and priorities in the computer area, judging approval and the Working Sport concept were discussed.
