AKC Board Minutes

May 2002

The Board convened Monday, May 13, 2002 at 11:20 a.m. after the meetings of the various Board Committees. All Directors were present, except Mr. Marden, as were the Chief Operating Officer and Executive Secretary.

The Board reviewed the April 2002 minutes. Upon motion made by Mrs. Strand, and seconded by Ms. Scully, the minutes of the April 2002 meeting, copies of which were made available to all Directors, were adopted (unanimously; absent, Mr. Marden).

The Chairman, Mr. Menaker, reviewed correspondence referred to him as Board Chairman.

The correspondence included an appeal from the Rock Creek Kennel Club for permission to hold its 2002 show within the two hundred mile conflict distance of the Ramapo Kennel Club. This request was made with the understanding that the club understood that it must find a new date in 2003. Following a motion by Mr. Goodman, seconded by Dr. Battaglia, it was VOTED (unanimously; absent, Mr. Marden) to approve this request for 2002 only.

There was a discussion on establishing a policy governing when it would be appropriate for a Board member to attend an AKC staff meeting.

Mr. Menaker and Mr. Sprung gave a report on the DOGNY project.

Mr. Menaker gave an update on the AKC/Eukanuba American Dog Classic. He indicated that the Orlando Art Museum would be having a six week exhibit of art from AKC and the AKC Museum at the time of the Classic.

Mr. Marden arrived at the meeting at this point in time.

There was an Executive Session to discuss personnel matters.

The President, Mr. Cheauré, gave an update on the staffing of the Communications Department.

There was a Web Marketing update.

Mr. Stevens, Chief Financial Officer, gave a financial update. The Financial Report for April 2002 showed an excess of revenue over expenses of $961,000 for the month.

The individual registration figures for April 2002 are 93,159, versus 91,808 for April 2001.

The litter registration figures for April 2002 are 37,079 versus 36,377 for April 2001.

The Board agreed that there would be a Board retreat on the dates of August 19-20.

The Board considered locations for Delegate meetings in 2003. The March and September meetings where there are Board and Delegate Committee elections are to be held in the New York area. The December meeting is to be held with the AKC/Eukanuba American Dog Classic. Following discussion, there was a Board consensus to hold the June 2003 meeting in the Portland, Oregon area

There was a report on the concept of a working dog sport given by Dr. Battaglia. It would incorporate many of the exercises in current AKC tracking, obedience, agility, and CGC. The goals would be to expand the number of individuals interested in AKC and AKC events and to provide a large pool of working dogs with characteristics and skills that could be useful in homeland defense. This concept is to be explored further by the Events and Clubs Committee. Staff was directed to do a cost analysis, a staffing analysis, a study to gauge the demand, the impact on current AKC programs and the number of potential participants.

Dr. Davies, Mr. Marden and Mr. Gladstone, members of the Appeals Committee, left the meeting prior to the report on Judges Applications.

Following completion of the report on Judges Applications, Dr. Davies, Mr. Marden and Mr. Gladstone returned to the meeting.

Mr. Slay, staff, participated in the portion of the meeting dealing with disciplinary actions.

There was a discussion on the AKC hardship policy governing the transfer of dogs recorded in the ownership of a suspended party. Following a motion by Mr. Merriam, seconded by Mr. Gladstone, it was VOTED (unanimously) to consider an amended hardship policy at this meeting, waiving the usual notice requirement.

Following a motion by Mr. Gladstone, seconded by Dr. Battaglia, it was VOTED (unanimously) to adopt the following, effective immediately:

AKC HARDSHIP POLICY
When a breeder (seller) has been charged, placed on referral or suspended, AKC will consider transfer and registration of dogs and litters owned by innocent third parties. The buyer must provide dated documentation (such as a cancelled check or veterinary records) that show the dog(s) was acquired before the breeder (seller) was charged, placed on referral or suspended. The parentage of the dog or litter must not be in question, and all other requirements for registration must be met.

There was a report on the actions taken by the AKC staff during the month of April 2002 on the cancellation of litters and individual registrations.

During the month of April, the registrations of 22 litters were cancelled: 5 because of impure breeding, 2 at the litter owners' request and 15 as a result of the Compliance Audit Program - DNA.

The cancellation of the 22 litters resulted in the cancellation of 23 registered dogs and rendered 67 dogs, members of these litters, ineligible for registration.

The following actions taken by the AKC Management Disciplinary Committee were reported:

Tom Tighe (Hoffman, NC) was suspended by the Event Committee of the Southeastern Brittany Club for having a physical altercation at its March 2, 2002 event. The AKC Management Disciplinary Committee imposed a suspension of six months, effective March 20, 2002, and a $300 fine.

Patric Abaravich (Los Angeles, CA) was suspended by the Event Committee of the California Coursing Association for unsportsmanlike conduct at its March 30, 2002 event. The AKC Management Disciplinary Committee imposed a public reprimand and a $100 fine.

Lori McCarrick (Huntington Beach, CA) was suspended by the Event Committee of the California Coursing Association for unsportsmanlike conduct, foul and abusive language and failure to follow judges' orders at its March 30, 2002 event. The AKC Management Disciplinary Committee imposed a public reprimand and a $100 fine.

Brian Long (Maryville, MO) was suspended by the Event Committee of the German Shorthaired Pointer Club of Lincoln Nebraska for disregard of published club regulations at its April 7, 2002 event. The AKC Management Disciplinary Committee imposed a public reprimand and a $100 fine.

The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective May 13, 2002, and imposed fines of $2000 each for failure to comply with the recordkeeping and identification requirements of Chapter 4 of the Rules Applying to Registration and Discipline. Further, reinstatement will be contingent upon their beginning with a new colony:

The AKC's Management Disciplinary Committee has suspended the following individual from all AKC privileges for a period of ten years, effective May 13, 2002, and imposed a $2000 fine for conduct considered prejudicial to the best interests of purebred dogs in connection with a finding of fact as indicated:

Barbara Onderdonk (Alexander, NC) - based on findings involving Animal Cruelty in District Court, State of North Carolina. (Shetland Sheepdog)

The AKC's Management Disciplinary Committee has suspended Anne Bush (Moorestown, NJ) from all AKC privileges for a period of six (6) months, effective May 13, 2002, and imposed a $500 fine for having submitted, or caused to be submitted two litter registration applications which she knew, should have known, or had a duty to know, contained false certifications. (Poodle and Maltese)

The AKC's Management Disciplinary Committee has suspended Paul Canada (Corbin, KY) from all AKC privileges for a period of ten (10) years, effective May 13, 2002, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and identification and failure to maintain his dogs and facilites in a manner acceptable to The American Kennel Club. (Yorkshire Terrier and Shih Tzu)

The AKC's Management Disciplinary Committee has suspended Maggie Canada (Corbin, KY) from all AKC privileges for a period of ten (10) years, effective May 13, 2002, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and identification and failure to maintain her dogs and facilites in a manner acceptable to The American Kennel Club. (Yorkshire Terrier and Shih Tzu)

The AKC's Management Disciplinary Committee has suspended Patricia Ann Clapp (Caulfield, MO) from all AKC privileges for a period of ten (10) years, effective May 13, 2002, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and failure to maintain her dogs and facilites in a manner acceptable to The American Kennel Club. The AKC's Management Disciplinary Committee has suspended Paula Ann Claycomb (Mammoth Cave, KY) from all AKC privileges for a period of ten (10) years, effective May 13, 2002, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and failure to maintain her dogs and facilites in a manner acceptable to The American Kennel Club. The AKC's Management Disciplinary Committee has suspended Kathy Crow (Indianapolis, IN) from all AKC registration privileges for a period of one (1) year, effective May 13, 2002, and imposed a $1000 fine for having submitted, or caused to be submitted, a registration application for a male Chihuahua which she knew, or should have known, did not contain the personal signature of the litter owner. (Multiple Breeds)

The AKC's Management Disciplinary Committee has suspended Joyce Heuser (Staffordsville, KY) from all AKC registration privileges for a period of one (1) year, effective May 13, 2002, and imposed a $1000 fine for having submitted, or caused to be submitted, a litter registration application and subsequent registration applications which she knew, or should have known, did not contain the personal signature of her co-owner. (Multiple Breeds)

The AKC's Management Disciplinary Committee has suspended Sandra Johnson (Cresline, CA) from all AKC privileges for a period of six (6) months, effective May 13, 2002, and imposed a $500 fine for having submitted, or caused to be submitted two litter registration applications which she knew, should have known, or had a duty to know, contained false certifications. (Miniature Schnauzer)

The AKC's Management Disciplinary Committee has suspended Kathy Rayborn (Winnsboro, LA) from all AKC privileges for a period of six (6) months, effective May 13, 2002, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications which she knew, should have known, or had a duty to know, contained false certifications. (Dachshund)

The AKC's Management Disciplinary Committee has suspended Eddaphine Wall (Corbin, KY) from all AKC privileges for a period of ten (10) years, effective May 13, 2002, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and identification and failure to maintain her dogs and facilites in a manner acceptable to The American Kennel Club. Mr. Goodman gave the Events and Clubs Committee Report on fines assessed clubs for late submission of date applications and judges panels.

Following discussion, there was a motion by Ms. Scully, seconded by Mr. Marden, and it was VOTED (unanimously) to make the Toy Fox Terrier eligible for competition in the Toy Group at all shows held on and after January 1, 2003.

Following discussion, there was a motion by Mr. Marden, seconded by Dr. Battaglia, and it was VOTED (unanimously) to make the German Pinscher eligible for competition in the Working Group at all shows held on and after January 1, 2003.

The committee had also discussed appeals to the cancellation of awards.

Mr. Merriam gave a report from the Business Committee. The committee had discussed the recovery of a portion of the cost of various AKC services. It also was planning to present the Board with a plan and a chronology for reaching the thirty million dollar reserves recommended by the AKC's auditors.

Mrs. Strand gave the report for the Public Relations and Public Affairs Committee. The committee discussed Communications Department hires, the AKC image campaign, and AKC legislative initiatives.

Mr. Menaker reported on a meeting held between representatives of AKC (Mr. Menaker, Mr. Cheauré, Mr. Stevens, and Mr. Crowley) and the AKC Canine Health Foundation (Mr. Falberg, Mr. Studebaker, Mr. Arnold, and Dr. Newman). The purpose was to explore ways to improve the working relationship between the two organizations towards their common goals, to minimize future problems, and to eliminate duplication of expenses. He indicated that the meeting was very positive.

Meeting reconvened at 8:00 a.m., Tuesday, May 14, 2002. All Directors, were present as were the Chief Operating Officer and Executive Secretary.

Dr. Battaglia gave a report from the Operations and Planning Committee.

There was a discussion on the requiring of DNA testing based upon customer complaints. Following a motion by Mr. Gladstone, seconded by Mr. Kelly, it was VOTED (unanimously) to adopt the following policy, effective July 1, 2002:

DNA TO RESOLVE CUSTOMER COMPLAINTS
Customers who question the accuracy of the recorded parentage of any litters and/or dogs should have an established procedure available, when possible, through the use of DNA to verify parentage. Complaints must be presented to AKC in writings specifying the nature of the allegations and must be accompanied by the $500.00 fee. If the allegation is sustained, the deposit is returned. If the allegation is not sustained, the deposit would be forfeited and become the property of The American Kennel Club. AKC will work with customers to make corrections where possible. Under the terms of this policy, in cases where the parentage is proven to be incorrect, the responsible parties will be billed for the DNA processing costs and correction fees. Registration services will be placed on hold until payment is made. In cases where parentage corrections can not be made, the necessary cancellations will be processed. The AKC disciplinary procedures will apply to exclusions discovered as a result of this policy.

Following discussion of the correction of litter records, there was a motion by Dr. Battaglia, seconded by Dr. Garvin, and it was VOTED (unanimously) that effective January 1, 2003, there will be a standard fee of $50 to be charged to make an approved correction to a previously registered litter.

There was a discussion on registration items that are indefinitely placed in a pending file when the item cannot be processed because of conflicting or insufficient information. Following a motion by Dr. Battaglia, seconded by Ms. Scully, it was VOTED (unanimously) that effective January 1, 2003, a customer will receive a written notice at the time an item is pended and a second written notice after 60 days. If the customer wishes to reactivate the item after twelve months, there will be a $50 reactivation fee.

The committee also discussed policies governing registered kennel names, the registration of imported dogs with outbreeding to another breed done more than three generations ago, the addition of registries in the Czech Republic and the Slovak Republic to the list of registries with pedigrees acceptable for AKC registration, and an alternate to the single registrant proposal.

There was a recess for a Board workshop, where the judging approval was discussed.

Upon returning to the regular meeting, the Chairman reported that he had received, and he distributed, the minutes of the last DNA Advisory Committee meeting. The Executive Secretary reported that a brief trailer on temperament testing was added to the master for the German Shepherd Dog breed standard video at the request of the German Shepherd Dog Club of America.
