AKC Board Minutes
January 2002

The Board convened Monday, January 7, 2002 at 11:25 a.m. after the meetings of the various Board Committees. All Directors were present as were the Chief Operating Officer and Executive Secretary.

The Board reviewed the November 2001 minutes. Upon motion made by Mr. Goodman, and seconded by Dr. Smith, the minutes of the November 2001 meeting, copies of which were made available to all Directors, were adopted (unanimously).

The Board reviewed proposed operating guidelines between The American Kennel Club (AKC) and The American Kennel Club Companion Animal Recovery Corporation (CAR) and the Trademark License Agreement whereby CAR is permitted to use AKC's trademark in connection with CAR's pet retrieval and database service. Following a motion by Mr. Menaker, seconded by Dr. Battaglia, it was VOTED (unanimously) to approve these guidelines.

The Chairman, Mr. Merriam, reviewed correspondence directed to him as Chairman.

There was a discussion on the proper protocol for disseminating information resulting from meetings of Board-appointed committees. The Chairman indicated that since these were Board-appointed committees, they should only report to the Board. The committee could include a request to the Board to have their minutes or highlights from their minutes disseminated.

The Board reviewed the minutes of the DNA Advisory Committee's October 10, 2001 meeting. Following a motion by Mr. Kelly, seconded by Mrs. Strand, it was VOTED (unanimously) to publish the highlights from the minutes of this meeting as requested by the committee.

There was a motion by Mr. Gladstone to publish the entire minutes of the DNA Committee's October 10, 2001 meeting. This motion failed for lack of a second.

Mr. Merriam discussed the formation of an AKC Advisory Group to give recommendations on the enhancement of AKC's art collection. Dennis Sprung was assigned the task of making recommendations on the structure and membership of such a committee which would be reviewed by the Board in February.

The Board reviewed the 2001 American Dog Classic. Following a motion by Mr. Kelly, seconded by Dr. Battaglia, it was VOTED (unanimously) that for 2002, Mr. Menaker would be Show Chairman, Al Cheauré, Assistant Show Chairman, and the Board would be the Show Committee. Mr. Menaker will be responsible for making all Board and AKC staff assignments for the show. Mr. Menaker also reported that for 2002 the top 25 dogs in each breed and variety, based upon dogs defeated in breed competition, would be invited.

Mr. Merriam opened discussion on the concept of a Pan American Canine Exhibition. Management was directed to explore this idea and to report back to the Board.

The President, Mr. Cheauré, gave a personnel update. There was an Executive Session to discuss personnel matters, with nothing reported out of session.

Mr. Cheauré gave an update on the AKC CAR Relief and Support Fund. As of the Board meeting, over $250,000 had been collected and all but $34,000 has been distributed.

Mr. Murphy gave a financial update. The Financial Report for December 2001 showed an excess of expenses over revenue of $181,000.

The individual registration figures for December 2001 are 65,421, versus 76,370 for December 2000.

The litter registration figures for December 2001 are 34,466 versus 35,546 for December 2000.

Following a motion by Mr. Menaker, seconded by Dr. Mays, the Board VOTED (unanimously) to adopt the following resolution:

AT A MEETING OF THE BOARD OF DIRECTORS
OF
THE AMERICAN KENNEL CLUB

Held on Monday, January seventh, two thousand and two, the following Resolution was unanimously adopted:

WHEREAS, Thomas G. Murphy joined the staff of The American Kennel Club in nineteen hundred and ninety-one as Controller; and,

WHEREAS, he was elected Vice President on March ninth, nineteen hundred and ninety-three; and,
WHEREAS, he was elected an Executive Officer, with the title, Chief Financial Officer, effective January first, two thousand and one; and,

WHEREAS, he served on the Corporate Management Committee from its creation in nineteen ninety-five until December thirty-first, two thousand and one; and,

WHEREAS, he served as a member of the Executive Committee from January first until December thirty-first, two thousand and one; and,

WHEREAS, he was instrumental in effecting The American Kennel Club reaffiliation with the American Kennel Club Museum of the Dog and with the formation of the American Kennel Club Canine Health Foundation and the American Kennel Club Companion Animal Recovery, serving as Treasurer and Board member of the latter; and,

WHEREAS, he was deeply involved in all financial aspects of a major relocation of American Kennel Club personnel from New York to Raleigh, North Carolina and the renovation of both of AKC's facilities; and,

WHEREAS, he was responsible for implementing a modern accounting system for the organization, as well as a comprehensive annual budgeting procedure; and,

WHEREAS, his oversight of The American Kennel Club's finances for the past ten years has helped to put it on a firm financial footing, going from a budget of twenty-six million dollars in nineteen hundred and ninety-one to well over fifty million dollars in two thousand and one; and,
WHEREAS, we are ever mindful of the great contributions he has made to The American Kennel Club; and,

WHEREAS, we will ever cherish our association with this distinguished businessman and friend;

NOW, THEREFORE, be it

RESOLVED, that the Directors of The American Kennel Club extend to him their most sincere best wishes for the years ahead and their deep appreciation for his dedicated service to The American Kennel Club.

Mr. Menaker gave the report for the Business Committee.

The committee reviewed a Publications revenue prior year adjustment and an analysis of costs and revenues for all events. The cost of running the AKC departments that support events is $8,449,709 and these departments generate a total of $2,280,865 in revenue, primarily through application and recording fees. There was also an update on the DOGNY program, which is proceeding on schedule.

Dr. Smith, Dr. Davies and Dr. Garvin, members of the Appeals Committee, left the meeting prior to the report on Judges Applications.

Mr. Hayes, staff, participated in the discussion on Judges Applications. Mr. Gladstone participated in the discussion, but left the meeting before the vote was taken. Upon motion made and seconded, it was VOTED:

Mr. Gladstone returned to the meeting after the vote on Judges' applications.

Following completion of the report on Judges Applications, Dr. Smith, Dr. Davies, and Dr. Garvin returned to the meeting.

Mr. Slay, staff, participated in the portion of the meeting dealing with disciplinary actions.

There was a report on the actions taken by the AKC staff during the month of December 2001 on the cancellation of litters and individual registrations.

During the month of December, the registrations of 5 litters were cancelled because of impure breeding.

The cancellation of the 5 litters resulted in the cancellation of 15 registered dogs and rendered 15 dogs, members of these litters, ineligible for registration.

The Board considered a request from the Bernese Mountain Dog Club of America to make DNA testing mandatory for the sire and dam of every litter before the litters would be eligible for AKC registration. The request was accompanied by a petition signed by seventy-four out of the club's five hundred and six members. During the Board discussion, it was pointed out that the club already had the ability to recommend DNA testing in its Code of Ethics or to require DNA testing as an eligibility requirement for entering BMDCA events. There was a motion by Mr. Gladstone to approve the Bernese Mountain Dog Club of America's request. This motion failed for the lack of a second. Management was directed to do a detailed analysis of any problems it saw with the proposal. This would be reviewed by the Board in February and then sent to the Bernese Mountain Dog Club of America for its comments.

The following actions taken by the AKC Management Disciplinary Committee were reported:

Larry Melebeck (Carson City, NV) was suspended by the Marin Retriever Club for conduct at its event on September 29, 2001. Specifically, Mr. Melebeck was charged with using foul and abusive language towards a judge at an event. The AKC Management Disciplinary Committee acted to suspend Mr. Melebeck from event privileges for a period of two months, effective October 27, 2001, and imposed a $100 fine.

Harold Clausen (Lakeville, MN) was suspended by the German Shepherd Dog Club of America for conduct at its event on November 10, 2001. Specifically, Mr. Clausen was charged with physical abuse and/or mistreatment of a dog at an event. The AKC Management Disciplinary Committee acted to suspend Mr. Clausen from all privileges for a period of six months, effective November 10, 2001, and imposed a $1000 fine.

Ken Sink (Manassas, VA) was suspended by the Friendship Hill Beagle Club for conduct at its event on October 27, 2001. Specifically, Mr. Sink was charged with using foul and abusive language at an event. The AKC Management Disciplinary Committee acted to suspend Mr. Sink from event privileges for a period of one month, effective November 14, 2001, and imposed a $500 fine.

The AKC's Management Disciplinary Committee has suspended Linda Jackson (Smithfield, KY) from all AKC registration privileges for a period of one (1) year, effective January 7, 2002, and imposed a $1000 fine for having submitted, or caused to be submitted, a registration certificate which she knew, or should have known, did not contain the signature of the recorded owner. The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective January 7, 2002, and imposed fines of $2000 each for failure to comply with the recordkeeping and identification requirements of Chapter 4 of the Rules Applying to Registration and Discipline. Further, reinstatement will be contingent upon their beginning with a new colony:

The AKC's Management Disciplinary Committee has suspended Larry Causey (Effingham, SC) from all AKC privileges for a period of ten (10) years, effective January 7, 2002, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and identification and for failure to maintain his dogs and facilities in a manner acceptable to The American Kennel Club. (Multiple Breeds)

The AKC's Management Disciplinary Committee has suspended Cathie-Kujala Montalta (Loganville, GA) from all AKC registration privileges for a period of three (3) months, effective January 7, 2002, and imposed a $500 fine for having signed AKC documents on behalf of another without having a properly completed POA form on file. (Rhodesian Ridgeback)

Mrs. Strand gave the report of the Public Affairs and Public Relations Committee.

The committee discussed an AKC image campaign which would involve making AKC signs and banners available to event-giving clubs, and received updates on the dog sculpture initiative, a Spanish version of the safety kit, and public relations and communications actions during the Classic.

Dr. Battaglia gave a report from the Operations and Planning Committee.

The committee further discussed the proposed amendment to the Rules Applying to Registration and Discipline concerning the registrant concept. A number of revisions to the proposal had been made based upon input from the Delegates Bylaws Committee. The proposal is to be sent to all Delegates after all input is received from the Delegate committees. It will be read at the September 2002 Delegates meeting for a VOTE in December, with a proposed January 1, 2004 effective date. Staff will also be compiling a list of Q and A's on this matter.

The Board considered a request from the Gordon Setter Club of America for the retirement of the "Rockaplenty" kennel name (Mrs. William Whitney Clark). Following a motion by Mr. Goodman, seconded by Dr. Battaglia, it was VOTED (affirmative, Mr. Goodman, Dr. Battaglia, Mr. Menaker, Ms. Scully, Dr. Mays, Dr. Davies, Mr. Kelly, Mr. Gladstone, Dr. Garvin, Dr. Smith; opposed, Mr. Marden, Mrs. Strand, Mr. Merriam) to approve this request. This followed a failed motion to table the request, which was made by Mr. Kelly and seconded by Mr. Marden, with the VOTE (affirmative, Mrs. Strand, Dr. Mays, Mr. Kelly, Mr. Merriam, Mr. Marden; opposed, Mr. Gladstone, Ms. Scully, Dr. Garvin, Dr. Smith, Mr. Menaker, Mr. Goodman, Dr. Battaglia, Dr. Davies). The issue was whether or not AKC should retire non-registered kennel names. Staff was directed to report back to the Board on this in February. In the meantime, no more non-registered kennel names will be considered for retirement until the Board has the opportunity to develop a clear policy covering this..

The Board reviewed a request from the Board of the Greyhound Club of America to remove the National Greyhound Association (NGA) from the list of domestic registries with pedigrees acceptable for AKC registration. There was a motion Dr. Battaglia, seconded by Mr. Menaker, to approve the Greyhound Club of America request. There was a motion by Mrs. Strand to table the main motion, which was seconded by Mr. Marden and it was VOTED (affirmative, Mrs. Strand, Mr. Marden, Dr. Mays, Dr. Davies, Ms. Scully, Mr. Kelly, Mr. Merriam; opposed, Mr. Gladstone, Dr. Garvin, Mr. Menaker, Dr. Smith, Dr. Battaglia, Mr. Goodman). There was then a motion by Mrs. Strand, seconded by Mr. Gladstone, and it was VOTED (unanimously) to place a moratorium on the processing of applications for National Greyhound Association dogs until further action is taken by the AKC Board.

The Board considered a request from the Saluki Club of America to add the Society for the Preservation of the Desert Bred Saluki (SPDBS) to the list of registries with pedigrees acceptable for AKC registration. There was a motion by Ms. Scully, seconded by Dr. Battaglia, to approve this request, effective immediately. The Parent Club had taken a vote on this issue and over 80% of the members voting were in favor of it. There was a motion by Dr. Smith, seconded by Mr. Menaker, to table the main motion, which motion failed with the VOTE (affirmative, Dr. Smith, Mr. Merriam, Mr. Gladstone, Mr. Menaker; opposed, Mrs. Strand, Dr. Garvin, Mr. Goodman, Mr. Marden, Dr. Mays, Dr. Davies, Mr. Kelly, Dr. Battaglia, Ms. Scully). The main motion was then VOTED (affirmative, Mrs. Strand, Dr. Garvin, Mr. Goodman, Mr. Marden, Dr. Mays, Dr. Davies, Mr. Kelly, Dr. Battaglia, Ms. Scully; opposed, Mr. Merriam, Dr. Smith; abstaining, Mr. Gladstone, Mr. Menaker).

Meeting reconvened Tuesday, January 8, 2002 at 8:00 a.m. All Directors were present except Mr. Menaker. The Chief Operating Officer and Executive Secretary were also present.

Dr. Battaglia continued with the report from the Operations and Planning Committee.

The committee was considering and had also discussed a proposed name change for the Jack Russell Terrier to the Parson Russell Terrier. This will be coming to the Board for a vote in February 2002. There had been a detailed discussion on the registrant concept proposal that was currently being reviewed by three Standing Delegate Committees.

It was moved by Mr. Goodman, seconded by Dr. Smith and VOTED (unanimously; absent, Mr. Menaker) to approve the Delegate credentials of the following persons, whose credentials have been published in two consecutive issues of the GAZETTE:

Following a motion by Mr. Goodman, seconded by Dr. Smith, it was VOTED (unanimously; absent, Mr. Menaker) to approve the Five Valley Kennel Club (Missoula, MT) membership application for a vote by the Delegates at the March 2002 meeting.

The Board considered a proposed amendment to Chapter 5, Section 8 of the Rules Applying to Dog Shows, submitted by the Kennel Club of Philadelphia, to enable specialty clubs that are holding their shows with all-breed events to offer certain trophies. The word "only" would be deleted from the section so that it would read:

"In shows held by breed Specialty clubs, awards for Best in Puppy, Twelve-to-Eighteen Month, Novice, Bred-by-Exhibitor, American-bred, and Open Classes, Best in any additional classes which the show-giving club may offer in accord with the provisions of Chapter 3, Section 12, in which the sexes are divided, may also be awarded on a three-time win basis provided permanent possession goes to the owner and/or breeder winning the award three times, not necessarily with the same dog, provided such prizes are offered by the show-giving specialty club itself or through it for competition at its shows."

Following a motion by Mr. Marden, seconded by Ms. Scully, this change was VOTED (unanimously; absent, Mr. Menaker). It will be read in March 2002, for a VOTE at the June 2002 Delegates meeting.

The Board considered a proposed amendment to Chapter 12 of the Rules Applying to Dog Shows, submitted by the Chow Chow Club, to make the printing of the breed standard in the show catalog for every National Specialty mandatory. Following a motion by Mr. Goodman, seconded by Mr. Kelly, it was VOTED (affirmative, Mr. Goodman, Mr. Kelly, Mrs. Strand, Dr. Davies, Ms. Scully, Mr. Gladstone, Dr. Smith, Mr. Marden; opposed, Mr. Merriam, Dr. Garvin, Dr. Mays, Dr. Battaglia; absent, Mr. Menaker) to adopt this proposal. It will be read in March 2002, for a VOTE at the June 2002 Delegates meeting.

The Board considered proposed amendments to Chapter 1 of the Regulations for Retriever Hunting Tests, which would clarify certain requirements and make the regulations more consistent with other performance events. The proposed amended sections are:

Revised Chapter 1, Section 6, paragraph 1 & 3,
"1. All judges of retriever hunting tests are required to have attended an AKC judges' seminar within three (3) years of the beginning date of the event scheduled to be judged. No person will be approved to judge any division or level that has not apprenticed or judged at that level or higher. The judges of each level or division must have a combined history of judging at least six times at the level or higher scheduled to be judged."

Chapter, 1 Section 8 delete paragraph 3

Chapter 1, Section 16, new paragraph 10:
"After entries have closed a dog may be moved up to the next level in a test in which it is entered when, according to the owner's records, the dog has met the title requirements for the test level for which it was entered. Notification must be made to the Test Secretary at least one-half hour before the start of the event. The owner/handler of the dog will be required to pay any additional entry fee(s) necessary to participate in the higher test level."

Chapter 1, new Section 17:
"The Hunting Test Committee may decline any entries or may remove any dog from its event for cause, but in each such instance shall file good and sufficient reason for doing so with the American Kennel Club."

Chapter 2, Section 1. new paragraph 5:
"The decision of the judges shall be final in all matters relating to the performance of the dogs."

There was a motion by Mr. Goodman, seconded by Ms. Scully and it was VOTED (affirmative, Ms. Scully, Mr. Goodman, Dr. Davies, Mrs. Strand, Mr. Marden, Mr. Kelly, Mr. Merriam, Dr. Mays; opposed, Mr. Gladstone, Dr. Garvin, Dr. Battaglia, Dr. Smith; absent, Mr. Menaker) to consider the above amendments at this meeting, waiving the usual prior notice requirement.

There was a motion by Mr. Marden, seconded by Ms. Scully, to adopt these amendments. There was then a motion by Mr. Gladstone, seconded by Dr. Garvin, to table this motion, which failed with the VOTE (affirmative, Mr. Gladstone, Dr. Garvin, Dr. Battaglia, Dr. Smith; opposed, Mr. Merriam, Ms. Scully, Mr. Marden, Dr. Mays, Dr. Davies, Mr. Goodman, Mr. Kelly, Mrs. Strand; absent, Mr. Menaker). The main motion was then approved (affirmative, Ms. Scully, Mr. Marden, Dr. Davies, Mr. Kelly, Mr. Goodman, Mr. Gladstone, Dr. Garvin, Mrs. Strand, Dr. Mays, Mr. Merriam, Dr. Smith; opposed, Dr. Battaglia; absent, Mr. Menaker), effective April 15, 2002.

The Board considered a proposed amendment to Chapter 1, Section 5 of the Agility Regulations to make the deadline for the submission of applications for Agility trials twenty-four weeks. Following a motion by Mrs. Strand, seconded by Ms. Scully, it was VOTED (unanimously; absent, Mr. Menaker) to adopt this change, effective March 1, 2002, which would affect trials held after August 30, 2002.

The Board considered an amendment to Chapter 1, Section 13 of the Agility Regulations to clarify what measures to take when a dog attacks a person or another dog. It was proposed to add the following paragraphs to Chapter 1, Section 13:

Chapter 1, Section 13. Declining Entries and Excusing a Dog From the Trial.
(Add the following paragraphs.)
"A dog that in the opinion of the judge attacks any person in the ring shall be disqualified.

The judge will excuse a dog that attacks another dog in the ring or if the judge witnesses a dog attack another dog while entering or exiting the ring.

The owner of any dog, which has been excused on two occasions for attacking another dog, will be notified that the dog is no longer eligible to be shown in Agility classes."

There was a motion by Mr. Gladstone, seconded by Ms. Scully, and it as VOTED (unanimously; absent, Mr. Menaker) to amend the first sentence of this proposal to read: "A dog that in the opinion of the judge attacks any person in the ring, shall be disqualified."

Following a motion by Mrs. Strand, seconded by Ms. Scully, it was VOTED (unanimously; absent, Mr. Menaker) to adopt this amendment, as amended, effective March 1, 2002.

The Events and Clubs Committee was also considering amendments to the Toy Fox Terrier standard, qualifications for the Vizsla Club of America Gun Dog Championship, amendments to the Retriever Hunting Test Regulations and Herding Regulations, a revision to the Pointing Breed Field Trial Rules affecting the requirements for a Weimaraner Field Championship, and numerous amendments to the Agility Regulations. The Herding proposals were recommended by the Herding Advisory Committee, and the Board would consider AKC staff recommendations as to which of those should be approved and which disapproved.

Following a motion by Dr. Smith, seconded by Dr. Battaglia, it was VOTED (unanimously; absent, Mr. Menaker; abstaining, Dr. Mays, Mrs. Strand) to disburse the previously budgeted $25,000 grant to the National Animal Interest Alliance (NAIA).

Mrs. Scully reported on her attendance at the Grand American Coonhound Hunt in Orangeburg, SC, where there were over forty-thousand spectators.

Mrs. Strand reported that the High Volume Kennel Committee was to meet on January 27-28 in Kansas City, MO. An announcement of the meeting was sent to clubs and to commercial groups in the surrounding area.

The meeting went into recess for a workshop session where judging approval and AKC member club Bylaw requirements were discussed.

The Board returned to regular session. Mr. Marden reported that the AKC Pointing Breed Gun Dog Championship is to be held in Sunnyside, WA starting on May 6 and that it is to be hosted by the German Shorthaired Pointer Club of Oregon.
