AKC Board Minutes
November 2001

The Board convened Monday, November 12, 2001 at 10:50 a.m. after the meetings of the various Board Committees. All Directors were present as were the Chief Operating Officer and Executive Secretary.

The Board reviewed the October 2001 minutes. Upon motion made by Ms. Scully, and seconded by Mr. Goodman, the minutes of the October 2001 meeting, copies of which were made available to all Directors, were adopted (unanimously).

The Chairman, Mr. Merriam, reviewed the Board's 2001 priorities. It was agreed that they would be reevaluated in April 2002 by the newly elected Board.

The President, Mr. Cheauré, gave a personnel update. He reported that candidates for the CFO position were being interviewed and that a search had begun to fill the newly created Communications Director position.

Mr. Cheauré gave an update on AKC's Disaster Relief Fund. To date, $221,000 has been collected. $180,000 is being donated to 77 search and rescue and veterinary support organizations that participated in the Search and Recovery efforts after September 11. Additional donations will be made as other groups that participated are identified.

Mr. Cheauré and Mr. Menaker gave an update on AKC's ongoing exploration of a pet health insurance program.

Mr. Cheauré reported that there has been a dramatic drop in both litter and individual registration figures for both September and October 2001.

Mr. Crowley, Executive Secretary, reported on the formation of an Accessions Committee that will evaluate any offers to donate artwork, books, or archival material to AKC to determine if it would be an appropriate addition to AKC's collection. The committee is to be chaired by Dennis Sprung, with Nicholas D'Altilio, Michael Swick, and James Crowley as members.

Mr. Murphy, Chief Financial Officer, gave a financial update. The Financial Report for October 2001 showed a net excess of revenue over expenses of $73,000.

The individual registration figures for October 2001 are 81,793 versus 92,972 for October 2000.

The litter registration figures for October 2001 are 36,618 versus 38,813 for October 2000.

Mr. Crowley reported that Elizabeth and Lena Tamboer of Tam-Boer Borzois, from Mahwah, New Jersey, have donated a Rosenthal Borzoi figurine to the AKC collection.

Mr. Hayes, staff, was present for the discussion on Judges Applications. Prior to considering applications, the Board considered two requests. The first was submitted by Sandra Dunn. In November 1998, the Board suspended Mrs. Dunn's privileges to apply for additional breeds for seven years due to misrepresentation of information on a judging application. This decision was affirmed by the Appeal Committee in July 1999. Whereas, the Disciplinary Guidelines adopted by the Board in October 2000 provide a five-year penalty for an aggravated category of this offense, it was VOTED to reduce Mrs. Dunn's suspension of application privileges to five years.

The second request was submitted by Mr. Fred Lanting, whose judging privileges were suspended indefinitely for disregard of AKC Rules, Regulations, and Policies. This action was taken by the Board in May 2000. It was VOTED to deny this request.

Dr. Smith, Dr. Davies and Dr. Garvin, members of the Appeals Committee, left the meeting prior to the report on Judges Applications. Mr. Gladstone participated in the discussion on Judges Applications, but left the meeting prior to the final vote. Upon motion made and seconded, it was VOTED

Following completion of the report on Judges Applications, Dr. Smith, Dr. Davies and Dr. Garvin returned to the meeting.

There was a report on the actions taken by the AKC staff during the month of October 2001 on the cancellation of litters and individual registrations.

During the month of October, the registrations of 19 litters were cancelled: 7 because of impure breeding, 2 at the litter owners' request and 10 as a result of the Compliance Audit Program - DNA.

The cancellation of the 19 litters resulted in the cancellation of 31 registered dogs and rendered 74 dogs, members of these litters, ineligible for registration.

The following actions taken by the AKC Management Disciplinary Committee were reported:

Mark Lagergren (Kansas City, MO) was involved in an Event Committee Hearing concerning his conduct at the Jayhawk Retriever Club at their event on September 15, 2001. Specifically, Mr. Lagergren was charged with using abusive and foul language. The AKC Management Disciplinary Committee acted to issue a public reprimand and imposed a $100 fine.

Marshall Durr (College Station, TX) was involved in an Event Committee hearing concerning conduct at the Heart of the Plains Kennel Club at their event on September 29, 2001. Specifically, Mr. Durr was charged with using foul and abusive language. The AKC Management Disciplinary Committee acted to issue a public reprimand and imposed a $100 fine.

Mileah Kay (Ocala, FL) was involved in an Event Committee hearing concerning conduct at the Macon Kennel Club at their event on September 1, 2001. Specifically, Ms. Kay was charged with using foul and abusive language. The AKC Management Disciplinary Committee acted to issue a public reprimand and imposed a $100 fine.

Larry J. West (Sidney, IA) was involved in an Event Committee hearing concerning conduct at the Sunflower German Shorthaired Pointer Club at their event on October 14, 2001. Specifically, Mr. West was charged with disruptive behavior at an event. The AKC Management Disciplinary Committee acted to issue a public reprimand and imposed a $100 fine.

The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective November 12, 2001, and imposed fines of $2000 each for failure to comply with the recordkeeping and identification requirements of Chapter 4 of the Rules Applying to Registration and Discipline. The AKC's Management Disciplinary Committee has suspended Ellen Fousel-Boisso (Kapowsin, WA) from all AKC privileges for a period of ten (10) years, effective November 12, 2001, and imposed a $2000 fine for failure to comply with the rules and regulations for recordkeeping and identification and for failure to maintain her dogs and facilities in a manner acceptable to The American Kennel Club. The AKC's Management Disciplinary Committee has suspended Joseph Pendon (Petaluma, CA) from all AKC registration privileges for a period of three (3) months, effective November 12, 2001, and imposed a $500 fine for having submitted, or caused to be submitted, a litter registration application for a Scottish Terrier litter and the resulting applications from this litter, which he knew, or should have known, did not contain the personal signature of his co-owner and no POA was on file. The AKC's Management Disciplinary Committee has suspended Connie Williams (Concord, CA) from all AKC event privileges for a period of one (1) year, effective November 12, 2001, and imposed a $1000 fine for having entered, or caused to be entered, a female Rottweiler which she knew, or should have known, had been spayed. (Rottweiler)

Mr. Goodman gave the Events and Clubs Committee Report on fines assessed clubs for late submission of date applications and judges panels.

The Board reviewed a proposed amendment to the Bred-by-Exhibitor Class to make it more restrictive and closer to the way the class was originally envisioned. The changes were first proposed by the Delegate Dog Show Rules Committee. Following a motion by Dr. Garvin, seconded by Mr. Goodman, it was VOTED (affirmative, Dr. Garvin, Mr. Goodman, Mr. Gladstone, Dr. Davies, Mr. Kelly, Mrs. Strand, Ms. Scully, Mr. Merriam, Mr. Marden, Mr. Menaker, Dr. Battaglia, Dr. Smith; opposed, Dr. Mays) to approve the amendment to Chapter 3, Section 7 of the Rules Applying to Dog Shows so that it would read as follow:

"The Bred-by-Exhibitor Class shall be for dogs that are:

Six months of age or older as of the first day of the show;

Not Champions of Record on the date of closing of entries for the show;

Individually registered with The American Kennel Club as of the date of closing of entries for the show;

Owned or co-owned by any of the breeders of record as of the date of the closing of entries for the show.

The person showing the dog in this class must be one of the breeders of record and one of the owners of record of this dog.

In any subsequent classes for which a dog from the Bred-by-Exhibitor Class becomes eligible, there are no restrictions as to who may handle."

The above will be read at the December 2001 Delegates meeting, for a VOTE in March 2002, with a proposed effective date of May 1, 2002.

The Board considered a proposed new section, Chapter 12, Section 7 of the Rules Applying to Dog Shows, to require that the AKC approved breed standard be printed in the catalog for every independent specialty show. The proposal was submitted by the Chow Chow Club. There was a motion by Mr. Gladstone, seconded by Dr. Smith, to adopt the amendment, to be read at the December 2001 Delegates meeting, for a vote in March 2002, with a proposed May 1, 2002 effective date. Following discussion, there was a motion by Dr. Garvin, seconded by Dr. Smith, and it was VOTED (affirmative, Dr. Garvin, Mr. Goodman, Mr. Merriam, Mr. Menaker, Mr. Marden, Dr. Mays, Mrs. Strand, Ms. Scully, Dr. Davies, Mr. Kelly, Dr. Battaglia; opposed, Mr. Gladstone, Dr. Smith) to table the motion, which removed it from further consideration at this meeting.

Based upon a recommendation of the Beagle Advisory Committee, and following a motion by Mr. Menaker, seconded by Mr. Kelly, it was VOTED (unanimously) to amend Chapter 9, Section 1 of the Beagle Field Trial Rules to add a procedure for "Gun Dog Brace on Wild Rabbit or Hare trials" to give clubs the option to hold a second trial in a format of their choice, and to schedule Beagle Field Trials on a calendar year rather than a fiscal year basis. This amendment will be read at the December 2001 Delegates meeting, for a VOTE in March 2002, with a proposed April 1, 2002 effective date. The amendment would read as follows:

"Chapter 9, Section 1. (First two paragraphs) All licensed and member Beagle field trials shall be run under one of the five (5) following procedures:

A. Braces on Wild Rabbit or Hare.
B. Small Packs on Wild Rabbit or Hare.
C. Small Pack Option on Wild Rabbit or Hare.
D. Large Packs on Hare.
E. Gun Dog Brace on Wild Rabbit or Hare.

Note: Under AKC policy Brace, Gun Dog Brace and Large Pack clubs may apply for a second trial in the format of their choice during the calendar year. Small Pack and Small Pack Option clubs wishing to hold a second trial during the calendar year must hold a trial of dissimilar format, i.e., Brace or Large Pack."

Following a motion by Mr. Goodman, seconded by Ms. Scully, it was VOTED (unanimously) to amend the procedures for Brace, Small Pack and Small Pack Option Field Trials, as recommended by the Beagle Advisory Committee, with a January 1, 2002 effective date, as follows:

7-I. After the running of first series has been completed, the judges shall announce which hounds they wish to see in second series and no other hounds shall be called to run in second series following this announcement except in the case of an error by the Judges in identification of a hound, and except further that the Judges may call for an additional hound to replace any hound that has been measured out at second series or is absent for second series measuring. A club must advertise that at an event, second and subsequent series may be run in accord with the Procedures for Small Pack trials, but otherwise, second and subsequent series shall be run in Braces. In bracing the hounds in second series, the hound having the highest score from first series must be announced as the first hound in the first brace, and its bracemate shall be the next highest scored hound which has not been braced with it in first series. The remaining braces in second series and all braces in subsequent series shall be braced in the same manner. No two hounds shall be braced together if they have run in the same brace or trio in an earlier series.

8-B In Small Pack Trials, the hounds shall be numbered consecutively as entered, starting with the number 1. Painting the number on the hounds will be the option of the club. If the hounds are painted, each hound shall have the number painted on both sides with a durable paint, the figures to be at least 3 � inches high and clearly visible, or wear color-coded collars. The colors to be used are red, white, blue, green, yellow, orange, black, pink and silver. The Field Trial Secretary and his assistant, if any, shall be the only persons to record each number against the name of the corresponding hound.

8-C The packs in first and subsequent series, except the winners pack, shall consist of four to seven hounds, except that when the class has only eight or nine hounds they may be run in one pack. The field trial committee shall decide how the class will be divided in first and second series and the number of hounds in each pack. The packs shall be drawn for in first and subsequent series. The hounds shall be run in packs as drawn regardless of ownership and the packs must be run in the order drawn. If there is a third series other than the winners pack, the judges shall decide and announce in the field, the number of packs and the number of hounds in each pack. The Judges shall arrange the hounds in numerical order in packs in the third series.

The Board discussed a proposed amendment to the Agility Regulations to amend Chapter 1, Section 5 to make the application deadlines consistent with other events. The new section would read as follows:

Chapter 1, Section 5. Making Application (paragraph 3)
"Effective for events to be held after June 30, 2002, applications for licensed or member trials must be received by The American Kennel Club at least 24 weeks prior to the date(s) of the event."

There was a motion by Mr. Goodman, seconded by Ms. Scully, to consider the approval of this proposal at this meeting, waiving the usual prior notice requirement. This motion was defeated, with the VOTE (affirmative, Mr. Marden, Ms. Scully, Dr. Davies, Mrs. Strand, Dr. Garvin, Mr. Goodman; opposed, Mr. Merriam, Mr. Gladstone, Dr. Smith, Mr. Menaker, Dr. Mays, Mr. Kelly, Dr. Battaglia).

The Board discussed a proposed amendment to amend Chapter 1, Section 13 of the Agility Regulations by retitling the section "Declining Entries and Excusing a Dog From the Trial" and by adding the following paragraph:

Chapter 1, Section 13. Declining Entries and Excusing a Dog From the Trial. "The judge will disqualify any dog that attempts to attack any person in the ring. The judge will excuse a dog that attacks another dog in the ring or while entering or exiting the ring as viewed by the judge, or that appears dangerous to other dogs in the ring. The owner of any dog which has been excused on two occasions for attacking or attempting to attack another dog will be notified that the dog is no longer eligible to be shown in Agility classes."

There was a motion by Mr. Goodman, seconded by Ms. Scully, to consider the approval of the proposal at this meeting, waiving the usual prior notice requirement, and it was VOTED (affirmative, Mr. Goodman, Ms. Scully, Dr. Davies, Mrs. Strand, Dr. Garvin, Mr. Marden, Mr. Kelly; opposed, Mr. Merriam, Mr. Gladstone, Dr. Smith, Mr. Menaker, Dr. Mays, Dr. Battaglia). Following further discussion, there was a motion by Dr. Garvin, seconded by Mr. Kelly and it was VOTED (unanimously) to reconsider this vote. The initial motion to consider at this meeting was withdrawn.

The Board discussed a proposed amendment to the Agility Regulations to amend Chapter 8 to modify the International Sweepstakes non-regular class to bring it in line with international Agility competitions by providing for a "Midi" classification as follows:

Chapter 8, Section 1. Non-Regular Agility Classes. Jump Heights
Jump Heights: The ISC Class shall be split into three (3) separate categories; Mini Agility for dogs measuring 13-3/4" and/or less at the withers, Midi Agility for dogs measuring 16-7/8" at the withers and/or less, and Maxi Agility for dogs measuring greater than 16-7/8" at the withers. As indicated in the equipment specifications for the ISC Class, dogs entered in Mini Agility jump 14" in height, dogs entered in Midi Agility jump 18" in height, dogs entered in Maxi Agility jump 26" in height. Exceptions and/or ranges exist at some jumps, see "Obstacle Specifications."

Judges: Only fully approved agility judges (non-provisional) will be approved to judge any ISC class. All judges shall submit course designs for review and approval four (4) weeks prior to the show.

OBSTACLE SPECIFICATIONS: (All specifications and performance requirements shall be as printed in Chapter 3, unless modified herein.)

A-Frame:
The A-Frame shall be in compliance with the 9'-0" panel specification. The apex of the A-Frame shall be set at 5'-6" for Mini and Midi dogs. The apex of the A-Frame shall be set at 6'-3" for Maxi dogs.

Pause Table:
Top set at 12" for Mini dogs, 16" for Midi dogs, 24" for Maxi dogs.
All Jumps including Bar Jumps, One Bar Jumps, Panel Jumps:
The top bar or panel shall be set at 14" for Mini dogs, 18" for Midi dogs and 26" for Maxi dogs.
Effective until July 1, 2003: If a club's equipment makes it impossible to set bars at the heights listed, bars may be set up to 2" lower.

Double Bar Jump:
AKC standard with parallel top bars set at 12"-14" for Mini dogs, 16"-18" for Midi dogs and 24" - 26" for Maxi dogs.

Triple Bar Jump:
AKC standard triple bar jump set with top bar at 12"-14" for Mini dogs, 16"-18" for Midi dogs and 24"-26" for Maxi dogs. The bottom two bars should be spaced evenly and ascending to height listed above. Total width of spread measured centerline of bar to centerline of bar should be approximately that of the standard AKC triple bar jump for 12", 16" and 24" height classes.

Broad Jump:
Jump length set at 16" to 20"for Mini dogs (2 boards used), 28"to 36" for Midi dogs (3 to 4 boards used) and 48" to 54" (4 to 5 boards used) for Maxi dogs.

Viaduct Jump:
(Add this paragraph beneath the existing first paragraph.)

The top of the viaduct shall be set at 12"-14" for Mini dogs, 16"-18" for Midi dogs and 24"-26" for Maxi dogs.

Ascending Spread Jump:
An Ascending Spread Jump is two bar jumps placed together to form a spread. The bars are placed in ascending order with the back bar set at 12"to 14" for Mini dogs, 16" to 18" for Midi dogs and 24" to 26" for Maxi dogs. The front bar shall be set at approximately 4" lower for Mini and Midi dogs and 6" lower for Maxi dogs. The distance between the two bars of the spread shall be approximately 10" to 12" for Mini dogs, 12"-16" for Midi dogs and 16"-22" for Maxi dogs.
Performance: Shall be the same as the Double Bar Jump.

(New Obstacle) Tire Jump:
The AKC standard tire jump shall be used with the height set at 12" for Mini dogs, 16" for Midi dogs and 24"for Maxi dogs as measured from the ground to the bottom of the tire opening.

Course Distances and Times: The standard course times are at the sole discretion of the judge, but shall generally follow these guidelines: (See Exhibit A)

Notes:
3. Course shall be measured once for Mini and Midi class (along a 14" jumping dog's path) and once for Maxi class (along a 26" jumping dog's path) using an efficient course path.

4. Spacing of obstacles shall generally comply with "AKC Course Design Guidelines."

5. In order to reflect the international challenge level in the Mini, Midi and Maxi agility classes, it is recommended that the judge designate a section or two of the course to reduce the spacing between obstacles from the Maxi Class to Midi/Mini Class (which can have the same course spacing).

Placements, Tied Scores: All ISC class placements are based on faults then time, whereas the dog with the fewest faults wins. In cases where dogs have the same number of faults, the dog with the lowest (fastest) course time prevails. Placements are given out separately to dogs in the Mini, Midi and Maxi categories. A tie with two (2) dogs having the same score and time will require a run-off.

Elimination Faults:
--Dog/handler contact that aids the performance of the dog.

There was a motion by Mrs. Strand, seconded by Ms. Scully, and it was VOTED (affirmative, Mrs. Strand, Ms. Scully, Mr. Kelly, Mr. Marden, Mr. Goodman, Mr. Menaker, Dr. Mays, Dr. Battaglia, Dr. Garvin, Mr. Gladstone, Dr. Davies; opposed, Dr. Smith, Mr. Merriam) to consider this matter at this meeting, waiving the usual prior notice requirement. Following a motion by Mr. Marden, seconded by Mr. Kelly, it was VOTED (unanimously) to adopt these amendments, effective January 1, 2002.

Mr. Goodman reported that the committee disapproved a request from the Spokane Boxer Club for permission to hold a show 230 miles from Spokane to hold an event in conjunction with the American Boxer Club's regional specialty.

Mr. Goodman reported that the committee disapproved a request from the Greater Hickory Kennel Club to continue to participate in a cluster located beyond the allowable distance from its territory, under Board policy.

The Events and Clubs Committee was also considering a rule amendment to permit the same trophy offerings at independent and designated specialties, and amendments to clarify the show application process.

Mr. Marden gave a report from the Pension Committee. He reported that the committee had approved changes to the Employees' 401(k) Plan and the Employees' Retirement Plan to conform to changes in the law. The plans must be amended and the changes submitted to the IRS by December 31, 2001.

Mr. Menaker gave a report from the Business Committee.

There was a discussion on a judges application fee to help defray over 1.5 million dollars in direct costs and $360,000 in indirect costs for the Judges Department. Following a motion by Mr. Menaker, seconded by Dr. Smith, it was VOTED (affirmative, Mr. Menaker, Dr. Smith, Mr. Merriam, Ms. Scully, Dr. Davies, Dr. Battaglia, Mrs. Strand, Mr. Goodman, Dr. Garvin, Mr. Kelly; opposed, Mr. Gladstone, Mr. Marden, Dr. Mays) to implement a fee of $25 per breed for all applications received after March 1, 2002, with the understanding that there would be future consideration given to the institution of an annual judging fee.

The Business Committee had also discussed superintending fees and pursuing the idea of requesting a postal stamp to honor the SAR dogs effort after September 11, 2001. While the superintending fees were being reviewed, staff was directed to extend the annual licenses of all superintendents for six months until July 1, 2002.

Dr. Battaglia gave a report from the Operations and Planning Committee.

The Board discussed the registrant concept, with the term "registrant" replacing that of owner in AKC rules, with mandatory contracts and AKC arbitration when multiple individuals had an interest in an AKC registered dog. The rule changes necessary to achieve this were reviewed and referred to the Delegate Bylaws and Parent Club Committees for input.

The Operations and Planning Committee had discussed a request from the Board of the Greyhound Club of America to delete the National Greyhound Association from the list of domestic registries with pedigrees acceptable for AKC registration. Staff was directed to prepare a summary of the history behind the addition of the registry to the AKC list over forty years ago as well as all of the pro and con arguments for the proposal that have been submitted. The committee also discussed a request from the Saluki Club of America to add the Society for the Preservation of the Desert Bred Saluki to this same list. It also discussed the compliance requirements for clubs to maintain their eligibility to hold conformation events.

Mrs. Strand gave the report of the Public Relations and Public Affairs Committee.

Mrs. Strand indicated that the committees had discussed the Westwood One repeat - messaging radio campaign, the search for a PR agency and the status of current legislation.

Mrs. Strand reported that the Harcourt Publishing Company has elected to use AKC's Kids Corner newsletter and to place it in the Oklahoma core curriculum for grades 5 to 8, which will reach over 90,000 students.

The committee had considered and was recommending the adoption of a proposal by Dennis Sprung for DOGNY, a public art initiative, which aims at raising over $2,250,000 for Search and Rescue dog organizations.

DOGNY will consist of three hundred fiberglass sculptures of a Search and Rescue dog, decorated by artists and sponsored by patrons in the public, private and dog club sectors. The exhibition of the sculptures will coincide with the first anniversary of the September 11, 2001 attacks. All proceeds will go to the AKC CAR Support and Relief Fund. AKC would provide an underwriting grant of $84,200 to launch the program.

The casts will be painted by artists in New York City, who will paint them according to their own (pre-approved by AKC) designs. The sculptures will be displayed in pre-selected sites in Manhattan with plaques bearing the title, artist and sponsor. After a three-month display period, all sculptures not pre-purchased by sponsors will be sold at auction, with the proceeds going to the AKC CAR Canine Support and Relief Fund.

There was a motion by Mrs. Strand, seconded by Dr. Battaglia, and it was VOTED (unanimously) to consider the DOGNY proposal at this meeting, waiving the usual advance notice requirement. Following a motion by Mr. Goodman, seconded by Mr. Gladstone, it was VOTED (unanimously) to approve the proposal and the $84,200 grant.

Ms. Scully reported that she and Dr. Battaglia had attended the German Shepherd Dog Club of America's recent National Specialty Show where there was a special Schutzhund demonstration, which included Tracking, Obedience, and Protection Work. She indicated that ten dogs participated in this demonstration, which was approved on a one-time basis by the AKC Board.

Meeting reconvened Tuesday, November 13, 2001 at 8 00 a.m. All Directors were present . The Chief Operating Officer and Executive Secretary were also present.

The Board reviewed the proposed 2002 Budget. The Chief Financial Officer was present. Following a motion by Dr. Battaglia, seconded by Mr. Kelly, it was VOTED (unanimously) to approve the 2002 Budget.

Following a motion by Mr. Menaker, seconded by Mr. Kelly, it was VOTED (unanimously) to approve the following special reserves for 2002 (in thousands of dollars).
