AKC Board Minutes
April 2001
The Board convened Monday, April 9, 2001 at 10:55 a.m. after the meetings of the various Board Committees. All Directors were present as were the Chief Operating Officer, and Executive Secretary.
The Board reviewed the March 2001 minutes. Upon motion made by Mr. Goodman, and seconded by Dr. Battaglia, the minutes of the March 2001 meeting, copies of which were made available to all Directors, were adopted (unanimously).
Following a motion by Mr. Marden, seconded by Ms. Scully, the Board VOTED (unanimously) to adopt the following resolution:
AT A MEETING
OF THE BOARD OF DIRECTORS
OF
THE AMERICAN KENNEL CLUB
Held on April ninth, two thousand and one, the following Resolution was unanimously adopted:
WHEREAS, Dr. Robert J. Hritzo was elected a Director of The American Kennel Club on March twelfth, nineteen hundred and eighty-five, serving until March thirteenth, two thousand and one; and,
WHEREAS, he was elected Treasurer of The American Kennel Club on March ninth, nineteen hundred and ninety-five, and served in that capacity until March ninth, nineteen hundred and ninety-nine; and,
WHEREAS, he served as Board Pro Tem Chairman from July ninth, nineteen hundred and ninety-six until September ninth, nineteen hundred and ninety-six; and,
WHEREAS, he served on numerous Board Committees during his tenure, including Privileges, Canine Health Research and Education, Judges Review, Show Operations, Judges Applications, Business, Communications, Pension, Audit, Operations and Planning, and Committee for the Future; and,
WHEREAS, he served as Chairman of the Canine Health Research and Education Committee from April tenth, nineteen hundred and ninety until April twelfth, nineteen hundred and ninety-four; Chairman of the Business Committee from April eleventh, nineteen hundred and ninety-five until April eighth, nineteen hundred and ninety-seven; and Chairman of the Pension Committee from April eleventh, nineteen hundred and ninety-five until April fourteenth, nineteen hundred and ninety-eight; and,
WHEREAS, he served as Board Liaison and Chairman of the Delegate Committee formed in nineteen ninety-two to recommend an interpretation of "change in appearance by artificial means" as it applies to show eligibility; and,
WHEREAS, subsequent to the Board's authorization for the formation of The American Kennel Club Canine Health Foundation on December twelfth, nineteen hundred and ninety-four, he became a founding Director as well as the Foundation's first President, serving in that capacity during its phenomenal growth until March, two thousand and one; and,
WHEREAS, his acknowledged expertise and devotion to matters pertaining to the health and welfare of purebred dogs, and to the financial health of the organization, have proved to be an invaluable asset to the Board of Directors as it addressed issues in these areas; and,
WHEREAS, we are ever mindful of the great contributions he has made and continues to make to The American Kennel Club and the Sport of Purebred Dogs; and,
WHEREAS, we will ever cherish our association with this distinguished surgeon, sportsman, and friend;
NOW THEREFORE, be it
RESOLVED, that the Directors of The American Kennel Club extend to him their most sincere best wishes for the years ahead and their deep appreciation for his many years of dedicated service to The American Kennel Club.
The Chairman, Mr. Merriam, discussed correspondence referred to him as Chairman. It was referred to various staff and Board Committees.

The Board Chair, David C. Merriam, and Vice Chair, Ronald H. Menaker, are ex officio liaisons to all committees as needed and requested.
There was a discussion about a possible Board retreat to discuss important issues in more depth than was possible at the monthly Board meetings.
Following discussion, it was agreed that the November 2001 meeting would be held in Raleigh, North Carolina.
There was a discussion on the appointment of Trial Boards. It was agreed that this would be considered at the May 2001 meeting and that any changes would be made at that time.
The Board considered the results of the poll on Delegate meeting sites. As of April 5, 2001, 20% of Delegates and 29% of member clubs have responded to the survey.
There was a motion by Dr. Battaglia, seconded by Mrs. Strand, and it was VOTED (unanimously) to direct staff to draft a second survey on Delegates meetings, which would be reviewed by the Board in May. The intent was to try to get a greater response so that the Board had a true picture of the wishes of the Delegate Body.
There was a discussion on the need to make the Delegates aware of what the Board Committees were considering before matters actually came to the Board for a vote. It was agreed that starting in May, the committee reports would include an agenda of items they had under discussion.
There was a discussion on the Board Priorities for 2001. They were assigned to individuals and committees and given tentative due dates as follows:
1. Representing the unrepresented. Giving a voice to those sectors of our sport that do not qualify for membership. Use of advisory councils. Events and Clubs Committee (10/01)
2. Major revenue enhancement. Business Committee (12/01)
3. Reevaluation of point system. Events and Clubs (10/01)
4. Define and expand relationships with foreign national kennel clubs. Chairman and Executive Secretary (8/01)

There was an Executive Session to discuss the election of Executive Officers and the setting of their salaries. Upon return to the regular session, it was reported that all Executive Officers were reelected and that their salaries had been set.
The President, Mr. Cheauré, gave a personnel update.
Mr. Cheauré gave an update on the December 2001 American Dog Classic.
Mr. Cheauré reported on financial projections and on the need to develop programs to raise additional revenue.
Mr. Murphy, Chief Financial Officer, gave the financial update. The Financial Report for March 2001 showed an excess of revenue over expenses of $476,000.
The individual registration figures for March 2001 are 115,616, versus 132,269 for March 2000.
The litter registration figures for March 2001 are 41,278 versus 49,465 for March 2000.
Mr. Crowley reported that Geraldine Hayes, AKC's Archivist/Historian, and he gave twenty-four visitors representing the British Sporting Art Trust and the National Sporting Library in Middleburg, VA, a tour of AKC's offices and art work on Sunday, April 1, 2001.
Mr. Crowley presented the background behind the Foundation Stock Service and the Foundation Stock Classes.
Following a motion by Mr. Kelly, seconded by Mrs. Strand, it was VOTED (affirmative, Mr. Kelly, Mrs. Strand, Dr. Davies, Ms. Scully, Dr. Battaglia, Dr. Smith, Mr. Marden, Mr. Goodman, Mr. Menaker, Mr. Merriam, Dr. Garvin, Mr. Gladstone; opposed, Dr. Mays) to place a moratorium on all competitive aspects of the Foundation Stock Service, thus suspending the eligibility of FSS enrolled dogs to compete in Obedience, Tracking and Agility events and the August 1, 2001 implementation of the Foundation Stock Classes at shows and the 2002 implementation of FSS breeds in performance events. This action was taken to evaluate the value of the program, to seek more input and to evaluate the long-term consequences.
Following a motion by Mr. Kelly, seconded by Ms. Scully, it was VOTED (affirmative, Mr. Kelly, Mrs. Strand, Dr. Davies, Ms. Scully, Dr. Battaglia, Dr. Smith, Mr. Marden, Mr. Goodman, Mr. Menaker, Mr. Merriam, Dr. Garvin, Mr. Gladstone; opposed, Dr. Mays) to make the moratorium effective May 1, 2001.
There was a discussion on the reinstatement/reactivation of judges. Office procedures require having both resigned and inactive status for the following reasons:
1) Resigned - When a judge requests resignation (for whatever reason) the record is amended on CMS to show Resigned status and the judge's name is published on the Secretary's Page of the next available issue of the Gazette. The paper file is disposed of after five years.
2) Inactive - There
are three types of inactive judges:
a) When a judge becomes an AKC employee, he or she is considered occupationally
ineligible to judge (together with any member of the immediate household). Employees
(and household members) are rendered inactive and their names published on the
Secretary's Page of the next available issue of the Gazette. Their
files are saved in Judging Operations Department.
b) When we receive return mail from a general mailing to all judges marked "no
forwarding address" or "unable to deliver" etc., etc., we check
the judge's records for the last judging assignment. If the last assignment
is more than five years ago, we mark the records inactive. The file is disposed
of after three months. The purpose of this system is to cull the files and Judges
Directory of those judges who for some reason are no longer active, without
presuming they are deceased.
c) Judges who have requested inactive status: Generally these are judges anticipating
a temporary situation of occupational ineligibility. Their files are saved in
Judging Operations Department.
Following a motion by Dr. Smith, seconded by Mr. Marden, it was VOTED (affirmative, Dr. Smith, Mr. Marden, Mr. Goodman, Mrs. Strand, Ms. Scully, Mr. Kelly, Mr. Menaker, Mr. Gladstone, Dr. Garvin, Dr. Mays, Dr. Battaglia, Dr. Davies; abstaining, Mr. Merriam) to adopt the following policy:
REINSTATEMENT/REACTIVATION POLICY
- All judges who voluntarily
request resignation must submit a letter to Judging Operations.
- Judges who become AKC employees (and members of their immediate household) will be placed on inactive status and need not submit a letter to Judging Operations; additionally, judges who have not been heard from for five years or more and cannot be located are also placed on inactive status.
- Judging Operations staff will notify the Board at its next meeting of any resigned or inactive judges, after which the judge's name will be published on the Secretary's Page in the next available Gazette.
- Judges requesting reinstatement of their judging privileges must do so in writing and successfully meet the current criteria. AKC Staff will review and validate the request and the Board will be notified at its next meeting. The judge's name and approved breeds/groups will be published as Reinstated on the Secretary's Page of the next available Gazette.
- Current employees (and members of their immediate household) who have letters on file "resigning" their judging privileges, will now be considered to be on inactive status and must meet current criteria should they wish to be reactivated upon leaving AKC.
CRITERIA:
Judges who have been on resigned/inactive status for less than one year would
receive automatic reinstatement/reactivation.
- Judges who have been on resigned/inactive status for more than one year may not need to reapply under the current system if they can document continuous in-depth activity in the sport (see Note).
- Judges who have been on resigned/inactive status for more than one year must reapply under the current system if they cannot document continuous activity in the sport (see Note).
- Eligibility and the reason for reinstatement/reactivation must be reviewed and validated by Staff.
- All individuals resigned/inactive for more than one year must be interviewed on current Rules, Regulations, Policies, Guidelines and Breed Standards; pass a Procedural Examination, Anatomy Test, and meet current requirements.
- Only previously approved breeds/groups may be reinstated/reactivated. In the case of a group(s) with a newly recognized breed(s), breed standard test(s) must be passed.
- Uncompleted Provisional requirements must be met before applying for additional breeds.
- Requests received from resigned/inactive judges meeting all eligibility requirements would receive automatic reinstatement/reactivation from AKC staff for all previously approved breeds/groups.
- The Board will be notified of all reinstatements/reactivations and the applicant's name and breeds will be published on the Secretary's Page of the next available Gazette.
Note: Continuous in-depth activity may include but not be limited to: judges who resigned to exhibit dogs on breed/group level; employment or Board service with AKC; licensed superintendent; dog food salesman or solicitor; publisher of a dog publication; other occupation or involvement at Conformation events on a weekly or monthly basis.
APPLYING FOR ADDITIONAL BREEDS:
- Individuals may apply for additional breeds at the time of request for reinstatement/reactivation, if eligible.
- Applications for additional breeds will be handled under the current application process.
There was a motion by Mr. Gladstone that Board members, upon request, be provided with the files of the judging applicants upon whom they are to vote. This motion was discussed but failed for the lack of a second.

Following completion of the report on Judges Applications, Dr. Smith, Dr. Davies and Dr. Garvin returned to the meeting.
There was a report on the actions taken by the AKC staff during the month of March 2001 on the cancellation of litters and individual registrations.
During the month of March, the registrations of 19 litters were cancelled: 7 because of impure breeding and 12 as a result of the Compliance Audit Program - DNA.
The cancellation of the 19 litters resulted in the cancellation of 12 registered dogs and rendered 85 dogs, members of these litters, ineligible for registration.
There was a discussion of a staff request for guidelines covering the penalty that should be assessed individuals that provide fraudulent information on an entry form in order to show an ineligible dog. There was a motion by Dr. Battaglia, seconded by Dr. Davies, to apply the following penalties:
Mitigated - one month and
$200
Standard - three months and $500
Aggravated - six months and $1,000
There was a motion made by Dr. Smith, seconded by Mr. Menaker, and it was VOTED (affirmative, Mr. Menaker, Dr. Smith, Ms. Scully, Mrs. Strand, Mr. Marden, Mr. Goodman, Mr. Merriam, Dr. Garvin, Dr. Davies, Mr. Kelly, Dr. Mays; opposed, Mr. Gladstone, Dr. Battaglia) to raise the penalty to:
Mitigated - three months
and $500
Standard - six months and $1,000

The following actions taken by the AKC Management Disciplinary Committee were reported:
Tim Kaske (Madison, WI) was suspended by the Event Committee of the Marshfield Area Kennel Club for having a physical altercation at its February 18, 2001 show. The AKC Management Disciplinary Committee imposed a suspension of six months, effective February 18, 2001, and a $300 fine.
GiGi Franklin (Austin, TX) was suspended by the Event Committee of the Alamo Dog Obedience Club for failure to properly control a dog at its March 11, 2001 trial. The AKC Management Disciplinary Committee issued a letter of reprimand and a $200 fine.
The AKC's Management Disciplinary
Committee has suspended the following individuals from all AKC privileges for
a period of ten years, effective April 09, 2001, and imposed fines of $2000
each for failure to comply with the recordkeeping and identification requirements
of Chapter 4 of the Rules Applying to Registration and Discipline. Further,
reinstatement will be contingent upon their beginning with a new colony:

The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective April 09, 2001, and imposed a $2000 fine for conduct considered prejudicial to the best interests of purebred dogs in connection with the conviction as indicated:

The AKC's Management Disciplinary Committee has suspended Sadira Wright (Nashville, TN) from all AKC privileges for a period of ten (10) years, effective April 9, 2001, and imposed a $2000 fine for having submitted, or caused to be submitted, 2 litter applications which she knew, should have known, or had a duty to know, contained false certification and for failure to comply with the rules and regulations for recordkeeping and identification. Mr. Marden gave the report of the Board Discipline Review Committee. The committee heard the appeal of Beth Gates (Bonifay, FL). On November 8, 2000 the Southeastern Trial Board heard charges preferred against Ms. Gates resulting from DNA testing conducted at her kennel where exclusions were indicated in two litters. The Trial Board sustained the charges and recommended a suspension of five years and a $1,000 fine. The Board adopted this recommendation at its December 2000 meeting, with the suspension effective December 11, 2000. The Board Discipline Review Committee recommended that the appeal be denied and VOTED to adopt the recommendation.
Mr. Goodman gave the Events and Clubs Committee Report on fines assessed clubs for late submission of date applications and judges panels.
It was moved by Mr. Goodman, seconded by Dr. Battaglia and VOTED (unanimously, with Dr. Mays abstaining on his own credentials) to approve the Delegate credentials of the following persons, whose credentials have been published in two consecutive issues of the GAZETTE:

The Board considered a request from the Greater Hickory Kennel Club for a permanent exception to the Board's policy requiring that a club holding two events each year outside of its area, utilize sites within one hundred miles of that area. Following a motion by Mr. Kelly, seconded by Mr. Goodman, it was VOTED (affirmative, Mr. Kelly, Mr. Menaker, Mr. Marden, Ms. Scully, Mrs. Strand, Dr. Davies, Mr. Gladstone, Dr. Battaglia; opposed, Mr. Merriam, Dr. Garvin, Dr. Mays, Dr. Smith, Mr. Goodman) to approve a one-year exception. Staff was directed to prepare a report on the May 1999 show approval policy, with input on whether it should have been applied to preexisting out -of-area shows.
Following a motion by Ms. Scully, seconded by Mr. Marden, it was VOTED (unanimously) to approve the addition of a new Chapter 14, Section 12A to the Field Trial Rules and Standard Procedure for Pointing Breeds, to add a National Amateur Championship for Gun Dog Brittanys as follows:
"A National Amateur Gun Dog Championship Stake for Brittanys shall be for dogs over 6 months of age, which by reason of wins previously made in Gun Dog stakes qualify under special rules approved by the Board of Directors. This stake shall be run not more than once in any calendar year by the Parent Club of the breed. The winner of such stake shall become a Field Champion of Record if registered in The American Kennel Club Stud Book, and shall be entitled to be designated 'National Amateur Brittany Gun Dog Champion of 20__."
The above proposed amendment is to be read at the June 2001 Delegates meeting, with a vote at the September 2001 Delegates meeting.
Mr. Menaker gave the report for the Business Committee. The committee had discussed GAZETTE advertising, homeowners/auto insurance, and an update on the Operating Funds Investment Performance.
Dr. Battaglia gave a report from the Operations and Planning Committee.
The committee reviewed the Breeders Education Business Plan for 2001.
The committee considered the Board's policy on the retirement of kennel names. Staff was directed to report on a procedure to ensure that there were no other ownership claims on a name proposed for retirement. It was also suggested that consideration be given to requiring that the name be out of use for a certain number of years before permanent retirement.
Following a motion by Ms. Scully, seconded by Dr. Battaglia, it was VOTED (unanimously) to approve an amendment to ARTICLE XI, SECTION 5 of the Bylaws. The second sentence is to be amended to read:
"All contracts on behalf of the AKC shall be executed by the President or by such Executive Officers or Vice Presidents as may be designated by the President, within such limits and guidelines as the President shall establish."
Under the Bylaws, effective January 1, 2001, only the Executive Officers may sign contracts. The amendment would give the President the prerogative of delegating this authority to additional Vice Presidents, which was the case before the changes were adopted. It will be read at the June 2001 meeting for a vote in September 2001.
Following a motion by Dr. Smith, seconded by Mr. Gladstone, it was VOTED (unanimously) to add the Ukrainian Kennel Union to the list of registries with pedigrees acceptable for AKC registration.
The Board considered a request from the Doberman Pinscher Club of America to withdraw the retirement of the Kai Esa kennel name. Following a motion by Dr. Battaglia, seconded by Dr. Smith, it was VOTED (unanimously) to grant this request.
Mrs. Strand gave the report for the Public Relations and Public Affairs Committee. The committee was given an update on AKC PR and communications and on procedures used by AKC Customer Service in addressing calls about dangerous dogs. Mrs. Strand also reported on the video of the AKC National Agility event.
Mrs. Strand reported that nominations were now being taken for the ACE awards, and that the fancy was being asked to submit the information on any dogs performing outstanding service to man or performing acts of heroism.
The committee had discussed AKC's CGC program and what AKC could do to get full value from it. It also reviewed the status of AKC's Dog Training Outreach initiative, where clubs were being surveyed.
Mrs. Strand also reported that AKC's Child Safety video would be debuted during the week of May 20, 2001, which is National Bite Prevention Week.
Mrs. Strand reported on AKC's efforts to reverse the proposed Continental Airline requirement that certain breeds by muzzled while being transported. The proposed requirement was subsequently abandoned.
The Board recessed to go into informal session to discuss the Handlers Program and the possibility of accepting show dog ads in the GAZETTE.
The Board returned to regular session. There was a motion by Dr. Smith, seconded by Mr. Kelly, and it was VOTED (unanimously; absent, Dr. Mays) to approve the application of the $100 application fee for handlers to the first year dues.
