March 8-9, 1999
The Board convened Monday, March 8, 1999 at 10:45 a.m. All Directors were present as were the President, Chief Operating Officer, and Secretary.The Board reviewed the February 1999 minutes. Upon motion made by Dr. Battaglia, and seconded by Mr. Goodman, the minutes of the February 1999 meeting, copies of which were made available to all Directors, were adopted (unanimously).
The Chairman, Mr. Merriam, reported on a letter submitted on behalf of the Irish Setter Club of America. The Board of Directors of the Irish Setter Club of America expressed its opposition to the registration of litters with multiple sires.
Mr. Merriam reported on a request from the Delegate Parent Clubs Committee for AKC financial support for a Parent Club weekend rescue conference. While receptive, the Board felt that a broader approach, focusing on a number of subjects important to Parent Clubs, e.g. breeders education, National Specialties, would be preferable. It was suggested that with the latter approach, AKC sponsorship in coordination with the Parent Clubs Committee would be appropriate. The Chairman indicated that he would discuss this with Dr. Brown, the Chairman of the Delegate Parent Clubs Committee.
Mr. Merriam reported on a letter he received from Norman Shuman, Delegate for the Hunterdon Hills Kennel Club, suggesting changes to the corresponding date system and to the manner in which judging panels are submitted. The letter was referred to staff, which is to review it and report back to the Board Events and Clubs Committee.
Mr. Merriam reported on the International Kennel Club show, held to support the Canine Health Foundation and the Foundation's Gala Dinner, where the Foundation presented AKC with an award to recognize its contributions to Canine Health research.
Dr. Hritzo, President of the Canine Health Foundation, also reported on this event. He indicated that the event drew over three thousand entries and that there was a very large gate. There were also over 800 attendees at the dinner. The event raised over $70,000 for the Foundation. He personally thanked the Board members and AKC staff who attended, showing the importance of the mission of the Canine Health Foundation.
The Chairman complimented the staff for its work in producing the 1998 Annual Report, which was distributed to the Board.
The President, Mr. Cheauré, reported on the status of AKC registrations. He indicated that after two months, 85% of litter applications and 65% of individual applications were being submitted with the higher fees. Mr. Cheauré also distributed copies of the "Puppy Pack," which is being sent to breeders as a giveaway to new dog buyers. The information in this pack is intended to encourage the individual registration of dogs.
Mr. Cheauré reported on television coverage of the AKC National Agility Championship. It was a full hour program broadcast eight times between January 17 and February 5, 1999 on Animal Planet. It included an AKC Public Service Announcement and a feature on the Canine Health Foundation. The show was viewed by 2.3 million people in 1.7 million homes.
Mr. Cheauré gave an update on the Raleigh Operations Facility renovations. Most contracts have been signed and construction is underway on all floors. He reported that the work is proceeding on schedule and within budget.
There was a discussion on GAZETTE subscriptions. It was suggested that staff prepare a report on how to increase single copy sales.
The Treasurer, Dr. Hritzo, gave a financial update. Mr. Murphy, staff, was present for this report. The Financial Report for February 1999 showed an excess of revenue over expenses of $277,000.
The registration figures for February 1999 (individual and litter registrations) are 128,032, versus 152,227 for February 1998.
The Board considered a request from AKC's independent auditors, Ernst & Young, for Board confirmation of the intended Board-designated funds as of December 31, 1998. Following a motion by Mrs. Strand, seconded by Mr. Goodman, it was VOTED (unanimously) to confirm that as of December 31, 1998 the Board-designated funds were intended to be as follows:

* The preliminary December estimate reported a reserve balance of $11,705. Additional accruals relating to 1998 transactions for Outbound Services, 260 Madison Avenue, Computer Reengineering and North Carolina Renovation were made in January before the final year-end closing.
The Board considered a request from the Gig Harbor Kennel Club for permission on a one-time basis to hold back-to-back shows at a site outside of the club's area on October 9 and 10, 1999. Following a motion by Mr. Goodman, seconded by Mrs. Strand, it was VOTED (unanimously) to approve the request.
The Board considered a request from the Vizsla Club of America for approval of the 1999 National Amateur All-Age and National Open All-Age Championships. Following a motion by Mr. Marden, seconded by Ms. Scully, it was VOTED (unanimously) to approve the following qualifications:
FOR THE 1999 NATIONAL CHAMPIONSHIP
Open to any Vizsla six months of age or older that has ever placed first, second, third, or fourth in an Open All-Age, Amateur All-Age, Open Limited All-Age, Amateur Limited All-Age, Open Gun Dog, Open Limited Gun Dog, Amateur Gun Dog, Amateur Limited Gun Dog, in which at least eight dogs have started in an AKC licensed or member field trial or a registered dog who has acquired Master Hunter title. Each dog shall be handled by the same handler in the first and second series.
FOR THE 1999 NATIONAL AMATEUR CHAMPIONSHIP
Open to any Vizsla six months of age or older that has ever placed first, second, third, or fourth in an Amateur All-Age, Amateur Limited All-Age, Amateur Gun Dog, Amateur Limited Gun Dog Stake in an AKC licensed or member field trial or a registered dog who has acquired the AKC Master Hunter title. Only persons who, in the judgment of the Field Trial Committee, are qualified Amateurs as defined in Chapter 14, Section 2 of the Rules for Pointing Breed Trials amended to December 10, 1996, may serve as scouts in the National Amateur Championship Stake. Each dog shall be handled by the same handler in the First and Second Series.
Following a motion by Dr. Smith, seconded by Dr. Hritzo, it was VOTED (unanimously) to add the Icelandic Kennel Club to the list of registries with pedigrees acceptable for AKC registration.
Following a motion by Dr. Smith, seconded by Mrs. Welsh, it was VOTED (unanimously) to add the following italicized statement at the end of Chapter 3, Section 7 of the Rules Applying to Dog Shows to clarify the interpretation of eligibility for the Bred-by-Exhibitor class:
The Bred-by-Exhibitor Class is intended as a breeder showcase. This is why handling in the class is limited to family and not to household. The legal ward situation is different in that the legal guardian/ward relationship is comparable to blood/adopted parent/child relationship both morally and legally. In some cases adoption is simply not an option.
For the above reasons, the Board of Directors has interpreted this section as follows:
PARENT: Father or mother means a biological or an individual who is a legal guardian to a minor under 18 years of age.
SON OR DAUGHTER: A son or daughter means a biological or adopted child, a stepchild or a legal ward. In the case of a legal ward, the child must be under 18 years of age for the purpose of this section.
The Board considered a request submitted by the Parent Clubs and All-Breed Clubs Committees to permit rotating National Specialty Shows to hold events within the conflict distance of an All-Breed show, without having to obtain clearance from that club. Both the National Specialty Show and the all-breed club would be permitted to offer classes for the breed. The request was for a three-year pilot study. There was concern over the negative impact this could have on an all-breed club if multiple large entry National Specialty Shows were held within the conflict distance on its show date. It was agreed that more input on this should be obtained from the Delegate All-Breed Clubs Committee.
Following a motion by Dr. Battaglia, seconded by Mrs. Strand, it was VOTED (unanimously) to approve the revisions to the Great Dane standard, as published in the GAZETTE. The changes are effective April 28, 1999.
Following a motion by Mr. Marden, seconded by Ms. Scully, it was VOTED (unanimously) to amend Chapter IX of the Regulations for Lure Coursing Trials and Tests as follows:
SECTION 3. STAKES, #5 - Add the word "excused" before dismissed on both lines.
SECTION 3. STAKES, #6 - Change Best of Breed runoff to "Best of Breed elimination."
Add a new SECTION 3, OPEN VETERAN STAKE. All remaining numbers are to be moved down accordingly.
SECTION 3. Add a new #7, renumbering the current #'s 7 and 8 as 8 and 9. The new SECTION 7 will read:
If BOB cannot be determined initially with one run, i.e., only three hounds, max., ALL winners of all stakes will be randomly drawn, until by a process of elimination, BOB can be determined by one final run.
Example: There is one stake of Veterans, one of Open, two of Specials, all four hounds will be randomly drawn and compete in two (2) courses of two (2). The winners of these courses will run again for BOB.
SECTION 4, #2, add the words "...either the entry form or" after the word agent.
SECTION 5. Add the following after the second sentence:
"In order for the maximum number of Championship points to be awarded to the BIF winner, there shall be at least two hounds in BIF competition."Mrs. Welsh, Ms. Scully, and Dr. Smith, members of the Judges Review Committee, left the meeting prior to the report on Judges Applications.

Following completion of the report on Judges Applications, Mrs. Welsh, Ms. Scully and Dr. Smith returned to the meeting.
Mr. Slay and Mrs. Fiore, staff, participated in the portion of the meeting dealing with disciplinary actions.
There was a report on the actions taken by the AKC staff during the month of February 1999 on the cancellation of litters and individual registrations.
During the month of February, the registrations of 27 litters were cancelled: 8 because of impure breeding and 19 because of the Compliance Audit Program - DNA..
The cancellation of the 27 litters resulted in the cancellation of 22 registered dogs and rendered 123 dogs, members of these litters, ineligible for registration.
The Board considered penalties that could be imposed for violations to the previously adopted policy governing when conditions of dogs and kennel facilities do not meet AKC standards. Following a motion by Ms. Laurans, seconded by Ms. Scully, it was VOTED (unanimously) to impose the following penalties:
Mitigated 1 yr./$100
Standard 5 yrs./$300
Aggravated 10 yrs./$500
It was voted to deny a request for reinstatement submitted by Freya L. Robison (Dallas, TX). Ms. Robison was suspended for five years at the December 11, 1995 Board meeting for exhibiting a Belgian Sheepdog with bands on the teeth.

It was reported that the following individual has been suspended for an additional fifteen (15) years, effective March 8, 1999, and fined $1000 for conduct considered prejudicial to the best interests of purebred dogs in connection with the conviction as indicated:
Nancy Elaine Hendleman (Marietta, GA) - based on her conviction in State Court of
Cobb County (GA) of Animal Cruelty. (Poodle - German Shepherd Dog)
The AKC's Management Disciplinary Committee has suspended James Holley (Amory, MS) from all AKC privileges for a period of ten (10) years, effective March 8, 1999, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications which he knew, should have known, or had a duty to know, contained false certifications. (Chihuahua - Poodle)
The AKC's Management Disciplinary Committee has suspended Valerie Jensen (Worcester, MA) from all AKC privileges for a period of two (2) years, effective March 8, 1999, and imposed a $300 fine for having submitted, or caused to be submitted, a litter registration application which she knew, or should have known, did not contain the personal signature of the owner of the sire. (Doberman Pinscher)
The AKC's Management Disciplinary Committee has suspended Eloise Lindsey (Smithville, MS) from all AKC privileges for a period of ten (10) years, effective March 8, 1999, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications which she knew, should have known, or had a duty to know, contained false certifications, and for failure to comply with the rules and regulations for recordkeeping and identification. The AKC's Management Disciplinary Committee has suspended Bathsheva Rifkin (New York, NY) from all AKC privileges for a period of ten (10) years, effective March 8, 1999 and imposed a $500 fine for having submitted, or caused to be submitted, registration information which she knew, or should have known, contained false certification. (Cavalier King Charles Spaniel)
The AKC's Management Disciplinary Committee has suspended Paul Sapp (Tipton, MO) from all AKC privileges for a period of ten (10) years, effective March 8, 1999, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications which he knew, should have known, or had a duty to know, contained false certifications. Mr. Goodman gave the Events and Clubs Committee Report on fines assessed clubs for late submission of date applications and judges panels.

Following a motion by Mr. Goodman, seconded by Mrs. Welsh, it was VOTED (unanimously) to defer action on the credentials of Norma Bennett Woolf to represent the Queen City Dog Training Club, Inc., so that staff may verify her occupational eligibility.
Following a motion by Dr. Battaglia, seconded by Dr. Smith, it was VOTED (unanimously) to approve the membership applications of the Australian Cattle Dog Club of America and the Texas Tri-City Obedience Club.
Mr. Goodman reported that the Delegate credentials of the following persons are to be published in the April and May 1999 issues of the GAZETTE:

Following a motion by Dr. Haines, seconded by Mr. Marden, it was VOTED (unanimously) to approve housekeeping amendments to the Constitution and Bylaws of The American Kennel Club. The proposals were originally submitted by the Delegate Constitution and Bylaws Committee and the Exploratory Constitution and Bylaws Committee recommended that they be adopted at this time. The changes would make all reference to the organization "AKC"; make the Bylaws gender neutral; refer to events and event committees rather than show, obedience and field trial committees; and preface the word "dogs" with purebred where applicable. These changes will be read at the June Delegates meeting, published twice in the GAZETTE and voted at the September 1999 meeting.
Dr. Battaglia reported that it had been agreed during the Business and Planning Committee meeting that pending items would be reviewed in April so that priorities could be set.
Dr. Smith made the suggestion that at Board meetings held prior to Delegate meetings, an effort be made to only have the Board handle mandatory items. This would enable the Board members to be available to attend Delegate Committee meetings. It was agreed that this idea would be discussed further at the May Board meeting.
There was agreement that time would be set aside in April to review the report of the Future Direction of Show Events Committee, and in May to review the Judges Review Committee report on the Judges Application process.
