December 13, 1999
The Board convened Monday, December 13, 1999 at 11:15 a.m. after the meetings of the various Board Committees. All Directors were present as were the President, Chief Operating Officer, and Secretary.The Board reviewed the November 1999 minutes. Upon motion made by Mrs. Welsh, and seconded by Mrs. Strand, the minutes of the November 1999 meeting, copies of which were made available to all Directors, were adopted (unanimously).
The Chairman, Mr. Merriam, reviewed correspondence, referred to him as Chairman.
Mr. Merriam reviewed the list of priorities that had been set in March 1999.
There was a discussion on a proposal for AKC to list and register handlers. Following a motion by Mr. Kelly, seconded by Ms. Scully, it was VOTED (unanimously) to adopt the following program, effective July 1, 2000:
AKC Listed and Registered Handlers Program
Goals for Handlers Program:
- Promote the health and welfare of dogs in the care of handlers.
- Educate and provide guidance to consumers and the fancy in general.
- Provide recognition of those handlers who meet established criteria.
AKC believes that implementation and administration of an AKC Listed and Registered Handlers Program will help ensure that the best interests of dogs and their owners are heeded by:
- establishing criteria for handlers regarding the care and presentation of dogs
- providing guidance for dog owners to assist them in selecting qualified handlers and breeders
- supporting current educational and public relations endeavors aimed at responsible pet ownership
- administering an apprenticeship program to encourage young people to learn the profession from qualified handlers
- overseeing all aspects of program compliance
- enforcing the policies and guidelines as necessary
The Listed and Registered Handlers Program will be administered by AKC. The AKC Board shall establish an Advisory Committee consisting of at least one DHG member and at least one PHA member and one handler belonging to neither organization and any other individuals the Board deems appropriate. Committee members representing DHG and PHA must maintain their membership in good standing with their respective organizations and with AKC during tenure. Travel expenses for Advisory Committee meetings will be paid by AKC.
Motivating Factors
- Listed and Registered Handlers
will be assigned an identification number, just as AKC judges.
- AKC will publish a list
of Listed/Registered Handlers, confirming the standards the handlers
have met to achieve the appropriate designation. This information will
be distributed by AKC and show-giving clubs as part of a public relations
effort to provide continuing education to the public about purebred
dogs and AKC events. AKC Listed/Registered Handlers will be listed monthly
in the Gazette and in show catalogs.
- AKC will attempt to make available to Listed/Registered Handlers various types of insurance coverage, through establishment of a national association of members from various segments of the fancy.
- Have seven years of experience showing dogs for a fee
- provide current rate schedule
- provide three reference letters: business, veterinarian, client
- each year worked for not more than two AKC Listed or Registered Handlers may substitute for up to one year of the seven years of required experience, with a maximum of four years as an apprentice
- Own or lease a vehicle appropriate for number and breeds transported to shows
- provide documentation of ownership or lease
- provide proof of vehicle insurance, i.e., copy of policy showing policy number
- provide proof of valid drivers’ license
- provide proof of current vehicle license plates
- Provide proof of care and custody liability insurance
- Provide proof of United States citizenship or resident alien verification
To be eligible to apply for Registered Handler status, applicants must meet the following criteria, in addition to requirements for Listed Handler status:
- Own or have a long-term lease on a kennel facility appropriate for breeds cared for
- provide documentation of ownership or lease
- provide complete layout and photographs
- provide proof of kennel insurance
- Meet facility criteria as recommended by AKC.
AKC staff will review applications to determine those individuals who meet the criteria for either Listed/Registered Handler status. Kennel and vehicle inspections will be conducted on a random and complaint basis by personnel as determined by AKC staff. An interview with an AKC representative is mandatory, and will include discussion of the applicant’s willingness and commitment to adhere to a strict set of standards as specified in the Code of Ethics. Applicant must be in good standing with AKC and knowledgeable of AKC rules governing dog shows, as well as knowledge of breed standards of dogs exhibited. Representatives will also inform the applicant of inspection reports, which will include results of inspection of vehicles and kennels, if applicable. An initial non-refundable application fee of $___ will be assessed, along with an annual fee of $___ for couples and $___ for individuals, as established by AKC’s Board of Directors. Falsification of the application will bar the applicant from Listed/Registered status for up to seven years and may subject applicant to AKC’s regular disciplinary process.
Code of Ethics
All Listed/Registered Handlers are expected to:
- avail themselves of educational
opportunities as may be established by AKC
- ensure that the welfare
of the dogs in their care is a priority, not only at dog shows but at
home and on the road
- conduct themselves in a
sportsmanlike manner at all times in their relationships with fellow
handlers, exhibitors, judges and clients, which includes courteous verbal
interchanges and a professional appearance.
- abide by all published
AKC rules applying to registration and dog shows.
- conduct their business
relationships with clients in a fair and honest manner, based on a published
rate schedule and handler/client agreement.
- provide clients with itemized
monthly billing statements, return of ribbons and trophies, and information
about their dogs’ placements at each show.
- ensure that clients thoroughly
understand payment and release terms.
- inform the AKC staff of any change in home address, kennel facilities or travel vehicle.
Listed/Registered Handlers are subject to discipline by AKC for violation of its rules and regulations. Complaints involving violations of these rules and regulations are covered by the existing AKC Disciplinary Guidelines. AKC Staff and Field Representatives will be in charge of investigating complaints about Listed/Registered Handlers. Non-show-related complaints will be investigated by AKC, and it will be the responsibility of the Board to determine the procedures for dealing with violations. The Board may also establish committees to handle issues related to procedures. Failure by an AKC Listed/Registered Handler to properly care for their dogs, including disappearance or death of dogs, may result in a loss of Listed or Registered status as well as possible suspension of AKC privileges if convicted according to AKC Disciplinary Guidelines.
The disciplinary system will be comprised primarily of warnings and fines, rather than suspensions.
Liability
AKC will endeavor to limit its liability from lawsuits from persons hiring an AKC Listed/Registered Handler by publishing appropriate disclaimers in all educational materials, in dog show catalogs, and on the Listed/Registered Handler application. The disclaimer states that AKC Listed and Registered Handlers have met established criteria for experience and facilities (if applicable) as of the specific date of inspection, but that AKC is not responsible in any way for the individual acts of Listed/Registered Handlers. Disputes between Listed/Registered Handlers and their clients will be dealt with by legal procedures instituted by the parties involved. AKC assumes no additional liability as a result of the suspension of any individual who commits an offense, regardless of whether that person is a handler or not.
Apprenticeship Program
An apprenticeship program may be established by AKC to encourage young people to learn the business from experienced professionals, thus reinstating the tradition of handlers teaching the next generation. It will be the responsibility of the AKC Listed/Registered Handler to attempt to educate the apprentice about all aspects of the dog handling profession. The Board shall evaluate the program annually.
Nothing in this program shall be construed as prohibiting anyone in good standing with AKC from showing dogs for others for pay.
There was an Executive Session to discuss personnel matters.
The President, Mr. Cheauré, reported on a number of matters. Messrs. Murphy, Perry and Slay, staff, were present for these reports.
Mr. Cheauré gave an update on the NBC Dateline program, focusing on puppy mills, which is scheduled for airing in February 2000.
The Board considered a staff presentation on the use of DNA in AKC’s Voluntary DNA Programs for parentage verification. Mr. Slay, staff, was present for this presentation and participated in the discussion. It has now been established that DNA profiles in the Parent Club Program and the Certification Program can be used to verify parentage. Accordingly, the following actions were proposed for these programs: as the DNA database permits, parentage verifications for registered litters will occur, and if exclusions are found, breeders will be notified; every effort will be made to cooperate with the breeders in establishing correct parentage based on additional information and submitted DNA samples. Litter corrections will be made based on DNA profiles, unless it is established that the litter has multiple sires. Additionally, in order to assist innocent parties, effective January 1, 2000, excluded litters will be corrected in all programs where parentage can be conclusively proven by the use of DNA. Litters that cannot be corrected will be cancelled. Following a motion by Dr. Smith, seconded by Mrs. Welsh, it was VOTED (unanimously) to adopt a policy whereby parentage verification will be used to underwrite the integrity of the registry in all DNA programs, effective for litters whelped on or after January 1, 2000. Excluded litters will be corrected, if possible, or otherwise they will be cancelled.
Mr. Murphy reported on AKC’s Employee 401(k) Plan. Following a motion by Mr. Marden, seconded by Mr. Goodman, it was VOTED (unanimously) to adopt the First Amendment to The American Kennel Club 401(k) Tax Deferred Savings Plan, effective July 1, 1999, to allow participation at age 18 and to allow loans.
There was a discussion on the Board-authorized Special Reserve. Following a motion by Dr. Battaglia, seconded by Ms. Scully, it was VOTED (unanimously) to approve the following restricted funds, effective December 31, 1999:

Mr. Cheauré gave an update on the North Carolina Operations Facility renovations.
There was discussion of a staff proposal to expand the cash management/short term investment program to include:
Establish an Investment Advisory Committee to review AKC’s investment policy annually stating the organization’s short and long-term objectives considering AKC’s cash flow needs and any "Not for Profit" investment restrictions.
- Pension Committee to assume
Investment Advisory Committee responsibility.
- Establish an independent
consultant to recommend investment policies and options. Formalize an
annual review of investments, investment managers and recommendations
as we have with the Pension Committee.
- Formalizing senior management
oversight. Currently, CFO reviews monthly cash and investment reconciliation.
Formalize process to include documented monthly CFO review and semi-annual
report to CEO and Investment Advisory Committee.
- Establishing approval procedures
for new investment classes. CFO to recommend changes in investment guidelines
to the Investment Advisory Committee.
- Reaffirm executive authority
limits and reporting requirements. Currently, staff follows the above
guidelines established by the Board. Continue current practice including
monthly reporting of investments.
- Requiring an annual random audit by independent investment consultant to review compliance to procedures, controls and safeguarding of assets.
Following a motion by Dr. Battaglia, seconded by Mr. Goodman, it was VOTED (unanimously) to adopt this proposal.
The Treasurer, Mr. Marden, gave a financial update. Mr. Murphy, staff, assisted in giving this report. The Financial Report for November 1999 showed an excess of revenue over expenses of $172,000.
The registration figures for November 1999 (individual and litter registrations) are 122,832 versus 123,460 for November 1998.
There was a report on a plan to outsource subscription service for the GAZETTE, Awards, and AKC Afield utilizing Kable Fulfillment Services, a division of Kable News Company. Following a motion by Mr. Marden, seconded by Ms. Laurans, it was VOTED (unanimously) to designate Bank One as the depository bank for subscription receipts, processed by Kable Fulfillment Services, effective January 1, 2000.
Mr. D’Altilio reported on the superintendents’ meeting held at the Raleigh Operations Facility the preceding week. Twenty-six superintendents were in attendance. The main purpose of the meeting was to establish a dialog and a free flow of information.
The Secretary, Mr. Crowley, reported on an appeal concerning Delegate eligibility. The Delegate candidate submitted by the Corpus Christi Kennel Club owns and operates a boarding kennel. Originally advised she was ineligible, the club contends that since this is only part of her business and since she only boards and does not sell dogs, she should be eligible to become a Delegate. In the absence of any motion to reconsider the application, the denial of approval stands. Staff was directed to notify the club accordingly.
Mr. Crowley reported that to date, thirteen countries have expressed an interest in attending AKC’s October 2000 World Congress, four have indicated they will not attend and four are uncertain.
Mrs. Welsh, Ms. Scully, and Dr. Smith, members of the Judges Review Committee, left the meeting prior to the report on Judges Applications.

Mr. Slay participated in the portion of the meeting dealing with disciplinary actions.
There was a report on the actions taken by the AKC staff during the month of November 1999 on the cancellation of litters and individual registrations.
During the month of November, the registrations of 40 litters were cancelled: 6 because of impure breeding and 28 because of the Compliance Audit Program - DNA.
The cancellation of the 40 litters resulted in the cancellation of 33 registered dogs and rendered 156 dogs, members of these litters, ineligible for registration.

It was reported that the following individual has been suspended for ten (10) years, effective December 13, 1999, and fined $500 each for conduct considered prejudicial to the best interests of purebred dogs in connection with the conviction as indicated:
Maria Stathacos (Valley Falls, NY) - based on her conviction in Town Court of Schaghticoke (NY) of failure to provide proper sustenance. (Great Dane)
The AKC’s Management Disciplinary Committee has suspended D. Ann Anderson (Riverton, WY) from all AKC privileges for a period of ten (10) years, effective December 13, 1999, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications which she knew, should have known, or had a duty to know, contained false certifications. (Multiple Breeds)
The AKC’s Management Disciplinary Committee has suspended Thomas Clark (Port Henry, NY) from all AKC privileges for a period of three (3) months, effective December 13, 1999, and imposed a $100 fine for having submitted, or caused to be submitted, litter registration applications which he knew, or should have known, did not contain the personal signature of the recorded owner, without having a Power of Attorney Authorization Form on file. Randel Geary (Williamsburg, KY) from all AKC privileges for a period of ten (10) years, effective December 13, 1999, and imposed a $500 fine for having submitted, or caused to be submitted, four litter registration applications which he knew, should have known, or had a duty to know, contained false certifications, and for failure to comply with the rules and regulations for recordkeeping and identification. The AKC’s Management Disciplinary Committee has suspended Floyd and Sharron Harrell (Conway, MO) from all AKC privileges for a period of ten (10) years, effective December 13, 1999, and imposed a $500 fine for failure to maintain their dogs and facilities in a manner acceptable to the American Kennel Club and for failure to comply with the rules and regulations for record keeping and identification. The AKC’s Management Disciplinary Committee has suspended Richard Mammarello (Brockport, NY) from all AKC privileges for a period of ten (10) years, effective December 13, 1999, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications which he knew, should have known, or had a duty to know, contained exclusions, and for failure to comply with the rules and regulations for recordkeeping and identification. The AKC’s Management Disciplinary Committee has suspended Shanti Torre (Arcadia, FL) from all AKC privileges for a period of ten (10) years, effective December 13, 1999, and imposed a $500 fine for having submitted, or caused to be submitted, a litter registration application to register a German Shepherd Dog litter which she knew, should have known, or had a duty to know, contained false certification as to the sire. The AKC’s Management Disciplinary Committee has suspended Mary Vote (Riceville, IA) from all AKC privileges for a period of ten (10) years, effective December 13, 1999, and imposed a $500 fine for having submitted, or caused to be submitted, three litter registration applications which she knew, should have known, or had a duty to know, contained false certifications. Upon completion of the above reports, Mr. Kelly, Ms. Laurans and Mr. Marden returned to the meeting.
Mr. Goodman gave the Events and Clubs Committee Report on fines assessed clubs for late submission of date applications and judges panels.
It was moved by Mr. Goodman, seconded by Dr. Smith and VOTED (unanimously) to approve the Delegate credentials of the following persons, whose credentials have been published in two consecutive issues of the GAZETTE:

Following a motion by Mr. Goodman, seconded by Dr. Battaglia, it was VOTED (unanimously) to approve the membership applications for the following clubs, which are to be VOTED at the December 1999 Delegates meeting:

Greater Murfreesboro Kennel Club, Inc., Murfreesboro, TN
Nisqually Kennel Club, Tumwater, WA

There was discussion on a proposal from the Delegate for the St. Louis Collie Club to raise the recording fee to $1.50 for dog shows. Following a motion by Dr. Battaglia, seconded by Mr. Marden, it was VOTED (affirmative, Mr. Merriam, Dr. Battaglia, Mr. Marden, Ms. Laurans, Ms. Scully, Mr. Kelly, Mr. Goodman, Dr. Mays; opposed, Dr. Hritzo, Mrs. Strand, Dr. Smith; abstaining, Mrs. Welsh) to approve the proposal and to include all events that currently have a $.50 recording fee (Obedience, Tracking Tests, Field Trials, and Hunting Tests). The amendment will be read at the March 2000 Delegates meeting for a vote in June 2000.
There was discussion on the funds remaining in the Breeders’ Education Committee Budget after the committee concluded its charge and submitted its final report to the Board. Following a motion by Ms. Laurans, seconded by Mr. Goodman, it was VOTED (unanimously) to amend and increase the Breeders’ Educationao Program 2000 Budget by $19,557, which is the originally budgeted amount that was not spent by the Breeders’ Education Committee in 1999.
There was a discussion on the proposed Parent Club Conference. Following a motion by Dr. Battaglia, seconded by Ms. Laurans, it was VOTED (unanimously) to budget $100,000 from the Board Set Aside for a Parent Club Conference that is to be coordinated with the Delegate Parent Club Committee.
Dr. Battaglia gave a report from the Business and Planning Committee.
There was discussion on a request that a breeder be permitted to use a surrogate dam to produce a litter using the fertilized egg from a nine-year-old Labrador Retriever bitch. Following a motion by Dr. Battaglia, seconded by Mr. Marden, it was VOTED (unanimously) to grant the request on a one-time trial basis utilizing the following criteria:
- The sire, dam and surrogate
dam must be AKC registered Labrador Retrievers, with AKC DNA profiles
on file. Each member of the resulting litter must be DNA tested before
the litter is AKC registered.
- The application to register
the litter must include a statement, certified by a veterinarian as
to the date the eggs were collected, inseminated, and implanted.
- Parentage by the indicated biological sire and dam will be verified by DNA testing.
The Board reviewed the use of "AKC" in a sponsorship agreement between MB-F and the AKC Canine Health Foundation. There was no objection to this agreement.
