August 9-10, 1999
The Board convened Monday, August 9, 1999 at 10:50 a.m. after the meetings of the various Board Committees. All Directors were present as were the President, Chief Operating Officer, and Secretary.
The Board reviewed the July 1999 minutes. Dr. Battaglia pointed out that the July minutes erroneously referred to a study of genetic twins at PE Ag Gen., as there is no such actual study being done at the lab. Upon motion made by Mr. Goodman, and seconded by Mr. Marden, the minutes of the July 1999 meeting, copies of which were made available to all Directors, were adopted as revised. (unanimously).
The Chairman, Mr. Merriam, reported on correspondence that had been directed to him as Chairman.
Mr. Merriam indicated that the Public Affairs staff, Jim Holt, AKC’s Legislative Consultant, and the Fancy are to be commended for the successful conclusion of the Doris Day Animal League legislation.
There was a brief report on recent gifts received by the AKC Museum of the Dog. Among the gifts are the dog library of Tom Stevenson. Following a motion by Dr. Smith, seconded by Mr. Goodman, it was VOTED (unanimously) to convey the Board’s appreciation to Mr. Stevenson for the gift on behalf of the Fancy.
Additional gifts donated to the museum included the art collection from the estate of Alvin Maurer, and an 1849 painting, the Levee, by George Henry Hall, which was donated by Gilbert Kahn. The proposed gift of the entire Herman & Judith Fellton collection was also discussed.
There was a brief discussion on the report received from the Exploratory Constitution and Bylaws Committee. The report included a request for a six-month extension in order to explore the portions of the Bylaws dealing with member clubs and Delegates. The Exploratory Committee also requested that Nina Schaefer and John Ronald, the Chairs of the Delegate Constitution and Bylaws Committee and the Delegate Strategic Planning Committee respectively, be added to the Exploratory Committee. Following a motion by Mrs. Welsh, seconded by Mrs. Strand, it was VOTED (unanimously) to approve these requests.
The Board revisited the list of priorities that had been set for 1999.
The President, Mr. Cheauré, reported on the status of the North Carolina Operations Facility renovation. Most renovated areas are occupied and the only outstanding contracts remain the loading dock, smoking area and the data center remain the only outstanding contracts.
Mr. Cheauré indicated that the new individual registration application was now being mailed out to all new litter owners.
The Treasurer, Mr. Marden, gave a financial update. Mr. Murphy, Vice President, was present for this report. The Financial Report for July 1999 showed an excess of revenue over expenses of $156,000.
The registration figures for July 1999 (individual and litter registrations) are 135,673, versus 151,727 for July 1998.

It was VOTED to suspend the judging privileges of Sandra Dunn for three months, effective September 9, 1999, and to fine her $250 for the repeated exhibiting of a dog co-owned by her on the same weekend and at companion shows to a show where she was judging.

Following completion of the report on Judges Applications, Mrs. Welsh, Ms. Scully and Dr. Smith returned to the meeting.
Mr. Slay, Vice President, participated in the portion of the meeting dealing with disciplinary actions.
There was a report on the actions taken by the AKC staff during the month of July 1999 on the cancellation of litters and individual registrations.
During the month of July, the registrations of 40 litters were cancelled: 12 because of impure breeding and 28 because of the Compliance Audit Program - DNA.
The cancellation of the 40 litters resulted in the cancellation of 37 registered dogs and rendered 171 dogs, members of these litters, ineligible for registration.
There was a discussion on the current guidelines for the length of suspensions for various offenses. The subject was referred to the Board Business and Planning Committee and staff was directed to prepare a report with its input.

The AKC’s Management Disciplinary Committee has suspended Doris Knight (Marengo, OH) from all AKC privileges for a period of ten (10) years, effective August 9, 1999 and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications which she knew, should have known or had a duty to know, contained false certifications, for failure to comply with the rules and regulations for recordkeeping and identification, and for failure to maintain her dogs and facilities in a manner acceptable to the American Kennel Club. The AKC’s Management Disciplinary Committee has suspended Gail Tucker (Hoosick Falls, NY) from all AKC privileges for a period of two (2) years, effective August 9, 1999 and imposed a $300 fine for having submitted, or caused to be submitted, a litter registration application which she knew, or should have known, contained a false certification as to the sire owner's signature. Upon completion of the above reports, Mr. Marden, Mr. Kelly and Ms. Laurans returned to the meeting.
Mr. Goodman gave the Events and Clubs Committee Report on fines assessed clubs for late submission of date applications and judges panels.
It was moved by Ms. Scully, seconded by Mr. Goodman and VOTED (unanimously) to approve the Delegate credentials of the following persons, whose credentials have been published in two consecutive issues of the GAZETTE:

Following a motion by Ms. Laurans, seconded by Dr. Hritzo, it was VOTED (unanimously) to amend the eligibility requirements for Junior Showmanship, effective January 1, 2000, to provide that:
"An individual listed as an agent is not eligible to compete in Juniors, nor any person who distributes rate cards or otherwise advertises themselves as handling dogs for pay in the show ring, or accepts payment for handling dogs."
Following a motion by Ms. Scully, seconded by Mrs. Strand, it was VOTED (affirmative, Ms. Scully, Mrs. Strand, Mr. Goodman, Mr. Kelly, Dr. Hritzo, Dr. Battaglia, Mr. Marden, Mrs. Welsh, Dr. Smith, Dr. Mays, Ms. Laurans; abstaining, Mr. Merriam) to adopt the following amendments to the Agility Regulations, effective November 1, 1999.
The following are proposed changes to the Agility Regulations:
Chapter 1 Section 6 Making Application
Change first sentence of second paragraph as follows:
A club may be approved to hold up to eight (8) licensed or member events in a calendar year.
Chapter 1 Section 12 Premium Lists
Add the following additional items required to be in a premium list as noted in paragraph 2:
Entry limits if any (including method for accepting entries to a limited entry trial).
List the location where entries will be accepted.
Chapter 1 Section 13 Closing of Entries, Entry Limitations, Running Order, Move-ups, and Judging Limitations
Change entire section as follows:
Each entry in a licensed or member club trial must be made on an official American Kennel Club entry form. Each entry form must be completed in full and must be signed by the owner or his agent duly authorized to make the entry. The information given on the form must be that which applies to the entered dog.
A trial-giving club may impose a numerical limit on entries in any or all trial classes. If entry limits are used it is recommended that a "total entry limit" be used, stating a total number of runs allowed per judge and for the entire trial. If entries are limited the numerical limitation(s) must be stated on the cover of the premium list.
Entries received prior to a published date and time that entries would first be accepted shall be considered invalid entries, and be returned as expeditiously as possible.
Entries must be received prior to the closing date and time published. Entries for an Agility trial may be accepted until the official closing date and time even though the advertised limit has been reached.
A club may choose either of the following methods for accepting entries to a limited entry agility trial:
"First Received" Clubs should set a date and time that entries will first be accepted. Entries shall be listed in order of receipt. The closing date for the trial shall not be less than fourteen (14) days prior to the trial.
"Random Draw" Clubs must set an "opening period" which shall not be less than a seven (7) day period (14 days recommended). The opening period shall have a start time and date, and finish time and date.
Entries received prior to a published date and time that entries would first be accepted shall be considered invalid entries, and be returned as expeditiously as possible.
To ensure a successfully run trial at clubs who choose the "Random Draw" entry method, the show giving club may at its option guarantee an entry spot in the trial for dogs of "Show Workers" that have agreed to work at the trial. The maximum number of dogs gaining entry in this manner shall be as follows:
30 dogs for 1st ring
25 additional dogs for each additional ring if rings are to be run simultaneously. Dogs gaining entry in this manner are part of the total entry limit listed in the premium list.
All other entries received during the opening period shall be treated equally without regard to date received or any other criteria. A random drawing of all entries received during the opening period shall be held within 48 hours after the "opening period" has ended, to determine which dogs will participate in the trial.
If the advertised limit has not been reached the remainder of the entry limit shall be filled by entries received after the "opening period" but before the final closing date based on a "first received" premise.
A maximum of ten (10) entries is allowed in each envelope submitted to the Trial Secretary for random draw. Each dog entered is considered a separate entry regardless of the quantity of classes that dog is entered in. Envelopes exceeding the 10 maximum entries shall be treated as an invalid entry and shall be returned to the sender.
The drawing shall be held in a public place and open to all interested persons. The results of the draw shall be made available to the people present at the draw. In conducting the drawing for entries, the trial secretary shall avoid any method that raises any questions as to its randomness and impartiality.
The trial secretary will conduct the draw on the date, hour and at the location specified for such in the premium list. Envelopes shall be drawn at random and entries contained within each envelope shall gain entry to the trial up to the entry limits specified in the premium list.
If an envelope is drawn that contains entries that would exceed the entry limit, then there shall be a random draw of the individual entries contained therein to fill the specified entry limit of the trial. The entry limits as listed in the premium shall not be exceeded.
When the advertised limit of entries has been drawn, all remaining entries shall be drawn for a position on the alternate’s list. If the advertised limit has not been reached, the remainder of the entry limit shall be filled by entries received after the "opening period", but before the final closing date based on a" First received" premise. The final closing date shall not be less than fourteen (14) days prior to the trial.
In either entry method, the club may contact exhibitors to notify them of their entry status prior to the closing date if entry limits have been exceeded. The club at its option may hold an alternate list up until the closing date. Entries exceeding the advertised limits shall be returned within seven days (7) of the closing date. Following the closing date the Trial Secretary shall promptly contact all entrants and advise them of their status.
Running order within a class shall be determined by a random drawing of entries in each class/height division, following the closing of entries. Multiple entries handled by the same person should be separated when possible.
A judging schedule and the results of the random drawing of running order with assigned arm band numbers shall be sent to handlers as soon as possible after entries have closed and at a minimum of seven (7) days prior to the event. Trial Secretaries shall include the following phrase on the notification: "Preliminary running order contingent on move up entries not yet received".
Dogs may be run in an order different from the order drawn (within a class) when, in the opinion of the judges or the Committee, such will result in a reasonable and desirable saving of time.
Move-ups Prior to a Set of Trials: Dogs shall be moved-up to a higher class at the request of the owner, as a result of qualifying for an agility title, provided that the request is made to the Trial Secretary not later than noon on the Monday preceding the set of trials for trials starting on a Thursday Sunday. For trials that start on Monday Wednesday, move-ups preceding the set of the trials shall be accepted if received by the Trial Secretary no later than seven (7) days prior to the trial (i.e., for a Tuesday trial move-up requests must be made prior to noon on the previous Tuesday). It is recommended that catalogs be printed with all dogs listed in the proper class that they are actually running in, having accounted for move-ups.
Day to Day Move-ups: Move-ups from day to day at a set of back-to-back agility trials shall be at the discretion of the club. The request for moving up must be made to the Trial Secretary not later than the day preceding the event. The club shall state clearly in its premium list whether move-ups will be allowed "day to day".
All move-up entries are subject to the availability of the class and payment of any difference in entry fee.
When a dog is moved up in the official catalog after the catalog has been printed, it is only necessary to input the following information:
- In the class
where the dog was moved from, indicate which class the dog has moved
to. (e.g., moved to Open 24")
- In the class where the dog has moved to, indicate the dog’s arm band number and what class it has moved from. (e.g., moved from Novice B 24")
Note: all base information (i.e., registered name, AKC number, etc.) need only be listed in the class the dog was originally entered in. The dog’s score should be recorded in the class that it has moved to.
Judging limits shall be 300 dogs maximum per day without regard to class level or type (Standard, JWW or non-regular classes). These judging limits may be exceeded only when the club as listed above has accepted move-ups.
Chapter 4 Section 5 General Scoring, Mandatory Elimination and Excusals
Add as the last item under the category of "The following faults call for mandatory excusal":
Exceeding the fault limit of the class. Fault limits may be applied only if both the judge and trial chairman agree that it is in the best interest of the trial to do so. If applied the fault limit shall be either three (3) or four (4) separate faults that would normally result in a score of less than 85. When a dog has reached the fault limit established, the dog shall be excused from the ring and the handler should endeavor to exit the ring in the most expedient manner possible.
Fault limits are allowed only in the Excellent A and B Standard and Excellent A and B JWW classes.
Mr. Goodman reported that the Events Committee discussed the interpretation of Chapter 11, Section 14 of the Rules Applying to Dog Shows as it pertains to Discrimination. This discussion included consideration of a staff recommendation. Following a motion by Ms. Laurans, seconded by Ms. Scully, it was VOTED (affirmative, Ms. Laurans, Mr. Kelly, Dr. Hritzo, Dr. Mays, Mrs. Strand, Mrs. Welsh, Mr. Goodman, Mr. Marden, Dr. Battaglia, Ms. Scully; opposed, Mr. Merriam, Dr. Smith) to consider this matter at this meeting, waiving the usual prior notice.
Following a motion by Dr. Battaglia, seconded by Mrs. Strand, it was VOTED (affirmative, Dr. Battaglia, Mrs. Strand, Ms. Laurans, Mr. Kelly, Mr. Marden, Mr. Goodman, Mrs. Welsh, Ms. Scully, Dr. Hritzo; opposed, Mr. Merriam, Dr. Smith, Dr. Mays) that at shows where championship points are not awarded, priority acceptance of dogs that have met a pre-announced level of achievement is not considered discriminatory.
Dr. Battaglia gave the report of the Business and Planning Committee.
The Board considered a request from the American Fox Terrier Club for the permanent retirement of twelve kennel names. Following a motion by Mr. Goodman, seconded by Mrs. Welsh, it was VOTED (unanimously) to retire the following kennel names:

Dr. Battaglia reported that the committee would be bringing forward a proposal to modify the criteria used to add a foreign registry to the above list for consideration at the September meeting.
Mrs. Strand gave the report of the Public Affairs and Marketing Committee. Mr. Cheauré indicated that AKC had hired the Public Relations firm of Howard Rubenstein Associates. Mr. Cheauré added that a decision should be made soon for an individual to head the Public Affairs area.
Mrs. Strand gave an update on the committee’s continued review of Pet Insurance.
Mrs. Strand reported that the committee would be bringing forward recommendations to support a War Dog Memorial and a commemorative stamp honoring war dogs.
Other matters being discussed by the committee included an additional Lifetime Achievement Award for a person with more general involvement, a Hall of Fame concept, an Ombudsman and the establishment of a for-profit subsidiary. Also on the committee’s agenda is a proposal for an educational program dealing with civic canine issues, e.g., dogs in parks, zoning, etc.
Mr. Marden gave the Discipline Review Committee report. James Bennett (Federal Way, WA) was suspended by the Event Committee of the Coeur D’Alene Dog Fanciers Association for sexual harassment of an exhibitor at its June 1, 1999 show. The AKC Management Disciplinary Committee imposed a suspension of three months, effective June 1, 1999, and a $100 fine. Mr. Bennett appealed this decision, with the appeal denied by the Board Discipline Review Committee.
There was an Executive Session to discuss personnel matters.

Meeting reconvened on Tuesday, August 10, 1999, at 8:00 a.m. All Directors were present, as were the President, Chief Operating Officer, and Secretary.
Mr. Cheauré gave the Board a demonstration of AKC’s new web site.
Dr. Battaglia reported on the Business Committee’s review of a registration problem. Based upon a request from the Newfoundland Club of America, the staff reviewed the records for all white and black Newfoundlands. This research revealed that five dogs, represented as Newfoundlands on their AKC foreign registration applications, were actually registered in their countries of birth as Landseer ECT’s. The committee had voted to recommend to the Board that these registrations be invalidated. There was a motion by Dr. Mays, seconded by Ms. Scully and it was VOTED (affirmative, Dr. Mays, Ms. Scully, Mr. Merriam, Mr. Goodman, Ms. Laurans, Mrs. Strand, Dr. Hritzo, Mrs. Welsh, Mr. Kelly, Dr. Battaglia, Mr. Marden; opposed, Dr. Smith) to vote on the Business Committee’s recommendation at this meeting, waiving the usual prior notice. Following a motion by Dr. Battaglia, seconded by Ms. Scully, it was VOTED (unanimously) to invalidate the registrations of the five dogs in question.
Ms. Scully reported on a study done by staff as a result of a recommendation from the Future Direction of Show Events Committee that AKC reevaluate the rules and policies governing show territory. In 1997 and 1998 there were 2,626 all-breed shows. In that time only three clubs were denied permission from the host club to use a site in that club’s territory. All three cases were resolved successfully:
- One club found an alternate site.
- One site was declared an open area, and both clubs used the site.
- The Board of Directors allowed the use of a site on a one-time basis. Clubs subsequently found alternate sites.
Based upon the above information, the Board of Directors saw no need to propose any amendment to existing rules and policies. Following a motion by Mrs. Welsh, seconded by Ms. Scully, it was VOTED (unanimously) to take no further action.
The Board recessed for a workshop to discuss the judging application process and AKC certification or approval of professional handlers. For the latter, representatives of the Dog Handlers Guild (Jane and Stan Flowers and George Ward), the PHA (Fred Olson, Mike Scott, and Corky Vroom), and the Handlers Certification Board (Melbourne T.L. Downing) were in attendance.
Dr. Battaglia reported on a request from the AKC Museum of the Dog for a grant of $40,000 to cover honorariums for 40 artists who are to be commissioned to do paintings for an exhibit on the Future Dog. This will be a traveling exhibit and arrangements have already been made to produce a book based upon it.
Following a motion by Dr. Smith, seconded by Ms. Laurans, it was VOTED (unanimously) to make the above grant.
Following a motion by Mr. Goodman, seconded by Mr. Marden, it was VOTED (unanimously) to take the $40,000 from Special Reserve #1.
Following the workshops, the Board reconvened.
